The City Attorney shall advise all officers and employees of the city relating to the duties of their respective offices, or employment and in all legal matters pertaining to the business of the city, giving when requested, his or her opinion in writing in relation thereto.

The City Attorney must conduct on behalf of the people all prosecutions for violation of the Charter or ordinances of the city in all courts in which the same may be instituted or to which the same may be transferred for appeal; provided, however, that upon the recommendation of the City Attorney, the Council may retain a special prosecutor, other than the City Attorney, to prosecute any or all such violations.

A. 
Designation of Appointive Officers. The City Council hereby designates the following appointive officers pursuant to Section 75 of the Charter:
1. 
Two (2) Assistant City Attorneys.
2. 
Deputy City Attorney.
3. 
Legal Analyst.
4. 
Legal Assistant.
B. 
Authority and Duties. Each of the appointive officers designated pursuant to this section shall have the authority and duties prescribed by the City Attorney, in accordance with class specifications approved by the City Council.
C. 
Exempt Status. Each of the appointive officers designated pursuant to this section are designated by the authority given the Council by Section 75 of the Charter, and shall not be subject to the provisions of Section 76.1 of the Charter. Accordingly, each of the appointive officers designated pursuant to this section are exempt from the civil service rules established pursuant to Section 76.1 of the Charter.
D. 
Appointment and Removal. Each of the appointive officers designated pursuant to this section shall be appointed by the City Attorney, and may be removed at any time by the City Attorney.
E. 
Unfilled Positions. Each of the appointive officers designated pursuant to this section may, in the discretion of the City Attorney, be held open and unfilled, depending upon budget authorization approved by the City Council. Nothing in this section is intended to require the City Attorney to either fill or hold open and unfilled any position specified in this code.
