A.
Designation of Appointive Officer. The City Council hereby designates a Parks and Recreation Services Director as an appointive officer, pursuant to Section 75 of the Charter.
B.
Authority and Duties. The appointive officer designated pursuant to this chapter shall have the authority and duties prescribed by the City Manager, in accordance with class specifications approved by the City Council.
C.
Exempt Status. The appointive officer designated pursuant to this chapter is designated by the authority given the Council by Section 75 of the Charter, and shall not be subject to the provisions of Section 76.1 of the Charter. Accordingly, the appointive officer designated pursuant to this chapter is exempt from the civil service rules established pursuant to Section 76.1 of the Charter.
D.
Appointment and Removal. The appointive officer designated pursuant to this chapter shall be appointed by the City Manager, and may be removed at any time by the City Manager.
E.
Unfilled Positions. The appointive officer designated pursuant to this chapter may, in the discretion of the City Manager, be held open and unfilled, depending upon budget authorization approved by the City Council. Nothing in this section is intended to require the City Manager to either fill or hold open and unfilled any position specified in this code.
F.
Change in Name of Department. This chapter was revised effective July 16, 2009, to reflect a change in the name of a city department from the "Community Resources Department" to the "Parks and Recreation Services Department." Therefore, any references (whether in this code or any other action of the City Council by resolution, minute action, or contract) to the "Community Resources Department" shall be deemed to mean the "Parks and Recreation Services Department," and any references to the "Community Resources Director" shall be deemed to mean the "Parks and Recreation Services Director."
