The Fire Chief shall be the head of the Fire Department of this city and shall be responsible for the maintenance and operation of all firefighting equipment and the conduct of the Department officers and employees in carrying out their duties of preventing and fighting fires in this city.

The Fire Chief shall report to the City Manager whenever required by him or her on the condition of the department and property thereof, and at any time when he or she may deem proper to report to the City Manager any matter that is necessary to be done or provided to insure the efficient operation of said Department.

The Fire Chief is authorized to draw up regulations governing the operation of the Fire Department and the duties of its members. These regulations when approved by the City Manager shall govern the operation of the Department and the conduct of its members. A copy of these regulations with the written approval of the City Manager endorsed thereon shall at all times be kept in the office of the Fire Chief.

The Fire Chief shall develop and implement an emergency command system ("system") for the effective management of fires and other emergencies. The Fire Chief shall be the highest-ranking officer in said system. The system shall assign an incident commander for all emergency operations. Said incident commander shall have sole authority for the direction of all emergency response personnel and equipment.

The Fire Chief and members of the Fire Department shall have power and authority of police officers and are authorized to exercise the powers thereof necessary to the performance of their duties as members of the Fire Department. Those members of the Fire Department regularly assigned to fire investigation duties shall have the right to carry and use loaded and/or concealed weapons in the performance of their official duties in accordance with written regulations prescribed by the Fire Chief, and are exempted from the provisions of California Penal Code Sections 12027 and 12031 and any and all further provisions of law restricting the right to carry loaded and/or concealed weapons.

The Fire Chief shall have control of all equipment and facilities assigned to the Fire Department or designated primarily for fire protection purposes. He or she shall determine the specifications, use, and assignment of such equipment, including the display of flags and emblems; use of vehicles, location, design and installation specifications of fire hydrants; design of specialized vehicles and equipment; and all other matters directly related to the delivery of fire protection services.

It is unlawful for anyone to willfully injure any engine house, hose, engine, carriage, or other apparatus, or drive over any hose of the Fire Department of this city.

No liability shall be incurred by the city on account of the Fire Department except such as shall be incurred or approved by the Council.
