For the purpose of this chapter certain terms, phrases, words and their derivatives shall be construed as specified in this section.
"Guest"
means any person hiring or occupying, on a temporary or transient basis, a room, or portion thereof, for sleeping purposes. It does not include a person who rents a house or apartment as a permanent place to reside.
"Hotel, motel, auto court and/or place used or intended to be used by guests for sleeping purposes"
means any building or group of buildings containing rooms intended or designed to be used or which are used, rented or hired out to be occupied, or which are occupied for sleeping purposes by guests, whether rent is paid in money, goods, labor or otherwise. It does not include any jail, hospital, asylum, sanitarium, orphanage, rest home, prison, detention home or other institution in which human beings are housed and detained under legal restraint.

A. 
Every person who owns or operates a hotel, motel, auto court and/or place used or intended to be used by guests for sleeping purposes shall keep on the premises and available at all times a permanent guest register in which shall be entered the following information:
1. 
Name and address of each guest who rents a room or rooms in the hotel, motel, auto court and/or place used or intended to be used for sleeping purposes.
2. 
Name and address of each member of the guest's party.
3. 
The number of the room or rooms rented by the guest.
4. 
The date that the room or rooms are rented and, the date that the guest departs.
B. 
If the hotel, motel, or auto court, etc., charges any fee for a person or persons to visit a guest of the hotel, motel, or auto court, etc., for any period of time, the person who owns or operates the hotel, motel, or auto court, etc., shall be required to keep and maintain a register of visitors that includes the name of each visitor. Every person who owns or operates a hotel, motel, or auto court, etc., shall require each guest to provide a legal form of identification.

Every person who owns or operates a hotel, motel, auto court and/or place used or intended to be used by guests for sleeping purposes or who is employed as a manager, desk clerk or person in charge of the desk or office at a hotel, motel, auto court and/or place used or intended to be used by guests for sleeping purposes shall make available for inspection and show upon request the guest register, required to be kept by Section 5.44.020, to any peace officer of the State of California.
