As used in this chapter, the following terms shall have the meanings set forth below:
"Adhesive label or sticker"
means any flat object made of paper, plastic, fabric, or other material, opaque or clear in color, designed to be written or printed upon and constructed with an adhesive material, such as glue, gum, or other polymer agent on at least a portion of the surface of the object, and is designed to be affixed upon a flat or curved surface.
"Felt-tip marker"
means any indelible marker or similar implement with a tip that, at its broadest width, is greater than one-eighth of an inch, containing ink or other pigmented liquid, which is not water-soluble.
"Graffiti"
means any unauthorized inscription, word, figure, picture, painting, design, or other defacement that is written, marked, etched, scratched, sprayed, drawn, painted, engraved, pasted, or otherwise affixed to or on any surface of any public property or private property within the City of Norwalk by or with, but not limited to, any of the following: felt-tip marker, paint stick or graffiti stick, or graffiti implement, to the extent that the same was not authorized in advance by the owner or occupant thereof, or, despite advance authorization, is otherwise deemed by the Director of Public Safety or the Director of Community Development to be a public nuisance.
"Graffiti implement"
means a felt-tip marker, spray can tips, adhesive label or sticker, paint stick or graffiti stick, etching tool including, but not limited to, glass cutters/etchers, etching creams, liquids, and other substances, or other devices made for, adapted for, or capable of scarring or leaving a visible mark on glass, metal, concrete, wood, or any other surface.
"Paint stick" or "graffiti stick"
means any device containing a solid form of paint, chalk, wax, epoxy, or other similar substance capable of being applied to a surface by pressure, and upon application, of leaving a mark at least one-eighth of an inch in width.
"Private property"
means any real property held by private interests which is used primarily for business, commercial, industrial, residential, or recreational purposes.
"Public property"
means any real property owned, leased, or maintained by a government, special district, public benefit corporation, or other public entity, including the City of Norwalk.

A. 
Except as provided in Section 9.14.020(B), it is unlawful for a person who is less than 18 years of age (a minor) to possess or have upon his or her person any graffiti implement, as defined in this chapter, while upon any public property.
B. 
Nothing in this section shall be deemed to prohibit the possession of items defined in this chapter as graffiti implements on the public property by a public employee or authorized agent of such public agency or any person under the direct supervision and control of such public employee or agent.

Any person violating any provision of this chapter shall be guilty of a misdemeanor and subject to the penalties stated in Norwalk Municipal Code Section 1.16.010.B.
