The purpose of this chapter is to establish regulations for the use of City skate park facilities.

As used in this chapter, the following terms shall have the meanings set forth below:
"Director"
means the Director of Recreation and Park Services, or designee.
"City skate park facility"
means any City facility at which skating on roller skates or skateboards is permitted and which has been designated as a "City skate park facility" by City Council resolution.
"Roller skates"
means any shoe, boot, or other footwear to which one or more wheels are attached. "Roller skates" includes in-line skates and roller blades.
"Skate park rules"
means rules established by the Director to govern use of City skate park facilities.
"Skateboard"
means any platform to which two or more wheels are attached, and which is intended to be ridden or propelled by one or more persons standing or kneeling upon it, and to which there is not affixed any seat or mechanism to turn or control the wheels.

The hours of operation for City skate park facilities shall be: April 1 to October 31, 8:00 a.m. to 8:00 p.m.; November 1 to March 31, 8:00 a.m. to 5:00 p.m., unless changed by the Director.

The Director may establish skate park rules, and may modify such rules from time to time as deemed necessary or appropriate. The Director shall ensure that each City skate park facility contains at least one conspicuously posted copy of the skate park rules. Such copy shall, at a minimum, afford reasonable notice of the safety equipment that must be worn while skating and that failure to comply constitutes grounds for citation.

Each person who skates at a City skate park facility shall wear a helmet, elbow pads and knee pads while skating.

It is unlawful for any person to do any of the following acts at a City skate park facility:
A. 
Use or remain in the facility outside of the designated hours of operation;
B. 
Violate the skate park rules;
C. 
Ride or use on the skating surface any device other than roller skates or skateboards. The devices subject to this prohibition include, without limitation: unicycles; go-carts; and wagons. Bicycles may be used only during designated days and hours posted at the skate park facility;
D. 
Ride or use any roller skates or skateboard in a reckless manner or with willful disregard for the safety of persons or property. Stunts, tricks and luge skateboarding by persons under 14 years of age shall constitute a violation of this provision;
E. 
Possess any can, bottle or other receptacle containing any alcoholic beverage that has been opened, has a seal broken, or the contents of which have been partially removed;
F. 
Possess any glass container;
G. 
Deposit or leave garbage, cans, bottles or papers in a location other than a receptacle provided for such purpose;
H. 
Inscribe graffiti in, on or around any part of the facility; and
I. 
Possess or keep an animal.

A violation of this chapter or the skate park rules shall constitute an infraction. Notwithstanding Section 1.01.050 of this Code, any such violation shall be punishable by:
A. 
A written notice of violation for a first violation;
B. 
A fine not exceeding $25 for a second violation of the same provision within one year;
C. 
A fine not exceeding $50 for a third violation of the same provision within one year.

A. 
When a minor is cited for a third violation within one year of the same provision of this chapter or the skate park rules, the Director may confiscate from such person any roller skates, skateboard or other equipment that is in such person's possession and was used to commit the third violation. Confiscated items shall be released only to a parent or legal guardian of the minor.
B. 
The Director shall expel from a City skate park facility any person who, within one year, commits four violations of the same provision of this chapter or the skate park rules. An expulsion order shall have a one-year term. Violation of an expulsion order shall be punishable as a misdemeanor.
