The following words and phrases shall have the meanings respectively ascribed to them in this section:
"Association"
includes corporations, syndicates, businesses or common law trusts, joint stock corporations, partnerships of all kinds, societies and individuals.
"Charitable"
includes the words philanthropic, social service, benevolent, patriotic, civic activity and eleemosynary, either actual or purported.
"Charitable purposes."
An activity is considered to be for charitable purposes when the net receipts from the activity to be conducted are to be used for philanthropic, charitable, benevolent, patriotic or civic activities.
"Contribution"
includes the words alms, food, clothing, money, subscription and property, and shall include donations under the guise of a loan of money or property.
"Promoter"
means any person who promotes, manages, supervises, organizes or attempts to promote, manage, supervise or organize a campaign for solicitation.
"Solicitation"
means the request, directly or indirectly, for money, credit, property, financial assistance or other thing of value on the plea or representation that such money, credit, property, financial assistance or other thing of value will be used for a charitable or religious purpose, as those purposes are defined in this section. These words shall also mean and include the following methods of securing money, credit, property, financial assistance or other thing of value on the plea or representation that it will be used for a charitable or religious purpose, as defined herein:
1. 
Any oral or written request;
2. 
The distribution, circulation, mailing, posting or publishing of any handbill, written advertisement or publication;
3. 
The making of an announcement to the press or over the radio, telephone, telegraph or television concerning or involving an appeal, assemblage, athletic or sports event, bazaar, benefit, campaign, contest, dance, drive, entertainment, exhibition, exposition, party, performance, picnic, sale or social gathering which the public or any portion thereof is requested to attend or patronize or to which the public or any portion thereof is requested to make a contribution for any charitable or religious purpose or benefit connected therewith;
4. 
The making of any sale, offer to sell or attempt to sell any advertisement, advertising space, book, card, chance, coupon, device, magazine, membership, merchandise, subscription, ticket or thing whatsoever in connection with which any appeal is made for any charitable purpose, or where the name of any charitable or religious association is used or referred to in any such appeal as an inducement or reason for the making of any such sale, or when in connection with any such sale, offer to sell or attempt to sell, any statement is made that the whole or any part of the proceeds from any such sale will go to, or be donated to, any charitable or religious purpose or association.
A solicitation, as defined in this section, shall be deemed completed when made whether the person making such solicitation receives any contribution or makes any sale herein referred to.

No person shall solicit contributions for any charitable or religious purpose, or in the name of or in behalf of any organization organized or existing for charitable or religious purposes, without first obtaining a permit therefor from the chief of police.

The provisions of Section 5.36.020 shall not apply to any solicitation made upon premises owned or occupied by the charitable or religious association upon whose behalf such solicitation is made, nor to any solicitation from members of said association.

Applications shall include the following information:
A. 
Written permission from two officers of the charitable or religious association to solicit any contribution in the name of or in behalf of such association;
B. 
The specific event for which the permit is requested;
C. 
Total amount of funds sought to be raised;
D. 
What percentage of the funds is to be used for expenses and what percentage of the funds is to be used for charitable or religious purposes;
E. 
If a promoter or noncharitable association or entertainment is to be used to raise funds for the charitable association, a list of the true and fictitious names, home and business addresses of the promoter and association.

A. 
Whenever any person or association is holding or sponsoring any assemblage, athletic or sports event, bazaar, benefit, campaign, contest, dance, drive, entertainment, exhibition, exposition, party, performance, picnic, sale or social gathering which the public is requested to attend or patronize by reason of any charitable or religious purpose or benefit connected therewith, the person or association shall designate members of its association who shall be present at all times on the premises where such event, as set out in this chapter, is being held for the purpose of maintaining control and supervision over the person or association operating the event and over-all funds collected.
B. 
The chief of police may, in his discretion, require a minimum number of members of the charitable association to be on the premises at all times during such event.

No person in making any solicitation for any charitable and religious purpose or association, or in connection with any such solicitation, shall use or give to any person either a fictitious name as his name, or an alias or any name other than his full, true and correct name, or the full, true and correct name and purpose of the charitable association for which he is soliciting a contribution.

No person shall make any misstatement, use deception or perpetrate any fraud in connection with the solicitation of any contribution for any charitable purpose to induce a contribution or promise of a contribution from any person.
