There is hereby created and established a Board appointed under the provisions of Section 2708 of the Borough Code,[1] to be known as the "Sharpsburg Parks and Recreation Commission," (hereinafter "Commission").

The Commission shall have and is hereby granted the authority to plan recreational programs for residents of and visitors to the Borough, supervise and schedule recreational events in the existing recreation places maintained by the Borough, or which hereafter may be established by the Borough, and shall for these purposes equip, operate and maintain the recreation places and make further recommendations to Council affecting the recreational activities at such recreation places and parks within the Borough. For purposes of this Subpart E, "recreation places" means any public parks, parkways and playgrounds, playfields, indoor recreation centers and gymnasiums.

The Commission shall consist of up to nine persons who shall be Borough residents, all of whom shall be appointed by Council and shall serve without compensation but may be reimbursed for necessary and reasonable expenses as may be approved by Council.

The term of each member of the Commission shall be for four years or until their successor is appointed; provided, however, that the original term of the members of the Recreation Board shall be staggered in such a manner that at least two appointees' terms shall expire annually.

All persons appointed shall serve their full terms unless they voluntarily resign or are removed by the Council for dereliction or neglect of duty, malfeasance, misfeasance or nonfeasance in office or for other just cause by a majority vote of the Council.

The office of any member of the Commission who shall fail to attend three consecutive meetings of the Commission without just or good cause may be declared vacant by the Council.

Vacancies in the Commission occurring otherwise than by expiration of term shall be filled by appointment for the unexpired term, in the same manner as original appointments.

The members of the Commission shall elect their own Chairperson and Secretary and select and create and fill such other offices as they may determine. Officers shall serve annual terms and may succeed themselves in the same office.

The Commission may adopt and alter bylaws, rules and regulations to govern its procedures consistent with ordinances of the Borough and laws of the commonwealth.

The Commission shall hold regular meetings at such times and places as it may designate and shall advise the Council and the public of such scheduled meetings.

The Commission shall promote public interest and participation in, and understanding of, the recreation places of the Borough.
2. 
The Commission shall hear and decide upon requests for use of Borough recreation places which the Council has placed under the jurisdiction of the Commission, with priority concern given to residents of the Borough.

The Commission may recommend usage fees and establish an operating budget for the use of recreation places, as deemed appropriate by the Commission. The operating budget and proposed usage fees shall be presented to Council for consideration and approval. Council may, in its discretion, approve or deny any such recommendations.
4. 
The Commission shall, no less than every three years, review the rules and regulations governing the operation and conduct upon the recreation places under the jurisdiction of the Commission and shall make recommendations to Council regarding proposed amendments to said rules and regulations.
5. 
The Commission shall, upon its own initiative or upon requests of interested parties, evaluate improvements or additions to recreation places or programs.
6. 
The Commission shall inspect recreation places annually and make a written report and recommendations to the Council regarding the condition of the facilities.
7. 
The Commission shall cooperate with other Borough boards or commissions with congruent interests including, but not limited to, the Zoning Hearing Board, Planning Commission, Shade Tree Commission, Environmental Advisory Council, and nonprofit organizations as needed to effectuate the purpose of this subpart.
8. 
The Commission shall review and make recommendations upon any matter referred to it by the Council. Council may expand or retract any powers and duties of the Commission by resolution.

Council may amend this list by resolution.
This subpart may be amended by resolution of Council.
