As used in this chapter, the following words shall have the meaning as defined in this section:
"Bicycle"
means a device as defined in the Vehicle Code.
"Police chief"
means and includes the chief of police of the city of Westminster, any policemen of the city of Westminster, and any other employee of the city designated by the police chief and approved by the city manager to enforce any of the provisions of this chapter.

Every person riding a bicycle upon a roadway or sidewalk shall be subject to all the duties of a driver of a vehicle by the provisions of this title, except as to those provisions which by their nature can have no application.

Any person who is the owner of or has charge or control of a bicycle within the city to be used upon the public streets of said city shall register and license each bicycle with the chief of police, which registration shall be for a three-year term, or as determined by the Department of Motor Vehicles.

No person shall ride or propel any bicycle upon any street, alley, park, bicycle path or other public place in the city which is not registered and for which the appropriate registration fee has not been paid, or which does not bear a sticker as required by the provisions of this chapter.

Application for the original registration of a bicycle shall be made by the owner thereof to the chief of police within ten days after its acquisition or its importation into the city upon appropriate forms furnished by the police department, and shall contain the full name and address of the owner and description of the bicycle, including the make and serial number.

A. 
Upon the registration of any bicycle and the payment of the fee required by this chapter, the chief of police shall stamp the identifying mark on the frame of the bicycle, and shall issue a license number to be affixed to said bicycle.
B. 
The chief of police shall keep a record of the date of issuance of each license, to whom issued, and the number thereof, and shall retain them for the period of time the license is valid.

Whenever any person sells, trades, disposes of or transfers any bicycle registered pursuant to the provisions of this chapter, he shall endorse upon the registration card heretofore issued for such bicycle a written transfer of the same, setting forth the name and address of the transferee, the date of transfer and the signature of the transferor, and shall deliver such registration card so endorsed to the transferee at the time of the transfer. Such transferee shall within ten days notify the chief of police of such transfer, and shall apply for a registration card. For the transfer of registration, the transferee shall furnish his name and address and shall exhibit his bicycle for inspection. Upon payment of transfer fees, the chief of police shall issue a new registration card for the bicycle.

When any bicycle which appears to have been lost, stolen or abandoned is found on any public or private property within the city, or is delivered to the police department, the chief of police shall, within ten days, make a reasonable effort to locate the owner of such bicycle, and if he is unable to locate said owner or in the event that said bicycle is not claimed by its owner within three months from the date of its possession by the police department, said bicycle shall be deemed abandoned and may be sold at auction as provided in this chapter.

A. 
Any unclaimed, lost, stolen or abandoned bicycle in the possession, care or custody of the police department, which is not claimed within a period of three months, shall be advertised for a sale at public auction to the highest bidder.
B. 
1. 
Notice of such sale at public auction shall be given by the chief of police, at least five days before the time fixed therefor, by publication in a newspaper of general circulation printed and published in the city, specifying the time and place where such public sale will be held, and generally describing the bicycle to be sold at public auction.
2. 
The chief of police may, in addition to said publication, publish to same notice in a newspaper of general circulation published in the county.
C. 
In the event the owner of such bicycle appears on or before the date fixed for the sale thereof at public auction and claims the bicycle, it shall be delivered to him.
D. 
In the event a bicycle is not claimed by the owner and cannot be sold at public auction, it may be given away to any fraternal, benevolent, patriotic or charitable or religious organization not organized for profit; provided, that if said bicycle is of no monetary value and cannot otherwise be disposed of by sale or gift, it may be destroyed as junk.

It is unlawful for any person to remove, destroy, mutilate, tamper with or alter the number on the frame of any bicycle registered pursuant to the provisions of this chapter; provided, however, that nothing in this chapter shall prohibit the chief of police from stamping numbers or letters on frames of bicycles in addition to the identification mark.

It is unlawful for any person to remove, tamper with, destroy, mutilate or alter any license number issued pursuant to the provisions of this chapter during the license period for which said license is issued.

No person engaged in the business of renting bicycles, either as a primary occupation or as a secondary or incidental occupation, shall rent or offer for rent any bicycle or permit same to be used by any person unless it is registered and licensed and a sticker is attached thereto, as provided in this chapter. Such bicycle must be equipped with the lamps and other equipment required by this chapter, other ordinances of the city or the laws of the state.

A. 
In the event any sticker is lost, stolen, mutilated or becomes illegible, the owner of the bicycle for which same was issued shall make application to the chief of police, within ten days, for a new sticker and registration card bearing the new registration number to the bicycle for which issued, upon payment of the fee provided in Section 10.84.100.
B. 
In the event that any registration card is lost, stolen, mutilated or becomes illegible, the owner of the bicycle for which same was issued shall make application to the chief of police for a duplicate registration card. The chief of police shall, upon satisfactory proof that the original registration card is illegible or has been lost, stolen or mutilated, issue a duplicate registration card, upon payment of the fee provided in Section 10.84.100.

No person shall park a bicycle upon a street other than against the curb, or upon a sidewalk other than in a rack or against a building or at the curb in such manner as to afford the least obstruction to pedestrian traffic.

A. 
No person shall ride a bicycle upon a sidewalk within any business district, or upon the sidewalk adjacent to any public school building, church, recreation center or playground. Peace officers shall be exempt from these provisions while in the discharge of their duties.
B. 
Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right-of-way to any pedestrian or to any vehicle exiting or entering any private driveway or alley.
C. 
It is unlawful to ride a bicycle or skate board on any sidewalk within the civic center complex. Peace officers shall be exempt from these provisions while in the discharge of their duties.

The chief of police shall have the right to impound and retain possession of any bicycle being operated in violation of the provisions of this chapter, and may retain possession of such bicycle until the provisions of this chapter are complied with, and all fees as provided in Section 10.84.100 have been paid, and if such bicycle is not claimed within three months, it shall be deemed to be abandoned.

The chief of police shall be and is hereby authorized to appoint deputies, with the consent of the city manager, to assist in the enforcement and carrying out of the provisions of this chapter.
