The purpose of this chapter is to promote the public peace, morals, health, safety and general welfare of persons in the city by regulating the activity of skateboarding and to establish a skate park to create a safe and accessible place for people of all ages to skateboard and roller skate in a clean, enjoyable environment.

As used in this chapter:
"Rollerskate"
means any footwear or device which may be attached to the foot or footwear, to which wheels are attached and such wheels may be used by the wearer for moving or propulsion, including, but not limited to, in-line skates commonly known as rollerblades.
"Safety equipment"
means, at a minimum, legal or approved helmets, elbow pads and knee pads.
"Skateboard"
means all wheeled objects, coasters, toys, conveyances, or similar devices used for transportation or sport which are propelled by human power and which are not classified as bicycles or rollerskates.
"Skate park"
means any area designated by resolution of the city council as a skateboard park for exclusive use of skateboards and rollerskates.

A. 
The city council may, from time to time, designate certain areas as a skate park. A skate park shall be designated as such by council resolution and shall be posted with all signs required by the California Health and Safety Code Section 115800 et seq., as may be amended.
B. 
All persons using a skate park are required to wear required safety equipment. Failure to wear said safety equipment shall be deemed a violation of this chapter and shall be subject to the penalty set forth in Section 12.34.050.
C. 
All skate parks shall have signs posted stating that all persons using a the skate park shall wear a helmet, elbow pads and knee pads and that failure to do so will result in the issuance of a citation pursuant to Westminster Municipal Code Section 12.34.050.

The following regulations shall apply for all skate parks:
A. 
No person shall skateboard or rollerskate at any times other than those established as the hours of operation.
B. 
No person shall use the skate park for uses other than for skateboarding and rollerskating.
C. 
No person shall use the skate park unless they wear the proper safety equipment as posted.
D. 
No person shall ride or cause to be ridden, a bicycle on the skating surface of the skate park.
E. 
No person shall use, or be under the influence of, alcohol or drugs while using the skate park.
F. 
No person shall litter or place trash or debris in or on the skating surface. All trash shall be placed in a designated trash receptacle and failure to do so shall be grounds for removal from the skate park.
G. 
No person shall apply or cause to be applied any vandalism, including, but not limited to, graffiti, tagging, stickers or decals, to any facilities in the skate park.
H. 
All persons shall skate or roller skate only on the skating surface and shall not skate or roller skate on the curbs and driveways of the city-owned area surrounding the skating surface.

Any violation of the provisions of this chapter shall be deemed to be an infraction, and punishable as such, notwithstanding the fact that at the discretion of the city or district attorney, the violation of any section of this chapter may be filed as a misdemeanor. The complaint charging such violation shall specify whether the violation is a misdemeanor or an infraction. Each day a violation of any provision of this chapter shall continue shall be a new and separate violation.
