Pursuant to the master drainage plan approved and adopted by Resolution No. 450 of the Westminster city council, the following local drainage districts are hereby established:
A. 
Drainage District No. 1. Drainage District No. 4. Beginning at the point of intersection of the centerline of Magnolia Street with the south line of the Orange County Flood Control District right-of-way, commonly known as the C-5 channel; thence southerly along said centerline to the centerline of Heil Avenue; thence westerly along last-mentioned centerline to the southerly right-of-way line of the San Diego Freeway; thence southerly along said southerly right-of-way line to the east line of Tract No. 3736; thence southerly along said east line to the south line of said tract; thence westerly along said south line and continuing westerly along the south line of Tract No. 3506 and continuing westerly along the south line of Tract No. 3440 and continuing westerly along the south line of Tract No. 3429 following last-mentioned tract line in a westerly direction to where the prolongation of said south line of Tract No. 3429 intersects the centerline of Beach Boulevard; thence northerly along last-mentioned centerline to the south line of the aforesaid C-5 channel; thence easterly along said south line of aforesaid C-5 channel to the point of beginning.
F. 
Drainage District No. 6. Beginning at the point of intersection of the centerline of Westminster Avenue with the centerline of Newland Street; thence easterly along the centerline of Westminster Avenue to the centerline of Bushard Street; thence southerly along last-mentioned centerline to the north line of the Orange County Flood Control District right-of-way, commonly known as the C-4 channel; thence westerly along said right-of-way line to the centerline of Newland Avenue; thence northerly along last-mentioned centerline to the point of beginning.

Drainage District No. 7. Beginning at the point of intersection of the centerline of Trask Avenue with the centerline of Newland Street; thence southerly along last-mentioned centerline to the north line of the Orange County Flood Control District right-of-way, commonly known as the C-4 channel; thence westerly along said right-of-way line to the intersection of the centerline at Edwards Street; thence northerly along last-mentioned centerline to the centerline of Maple Avenue; thence westerly along last-mentioned centerline to the centerline of Willow Lane; thence northerly along last-mentioned centerline to the west prolongation of the south line of Tract No. 1991; thence westerly along said prolongation and south line of Tract No. 1991 and Tract No. 1990 to the centerline of Springdale Street; thence northerly along last-mentioned centerline to the easterly prolongation of the centerline of Harold Place; thence westerly along last-mentioned centerline to the centerline of Graham Street; thence northerly along last-mentioned centerline to the south line of the Orange County Flood Control District right-of-way, commonly known as the C-3 channel; thence northerly along said right-of-way line to the centerline of the Garden Grove Freeway; thence easterly along last-mentioned centerline to the centerline of Newland Street; thence southerly along last-mentioned centerline to the point of beginning.

Beginning at the point of intersection of the south line of the Orange County Flood Control District right-of-way, commonly known as the C-4 channel with the centerline of Beach Boulevard; thence southerly along last-mentioned centerline to the intersection of the centerline of Roosevelt Avenue; thence south 68° west to the intersection of the centerline of Hoover Street; thence northerly along last-mentioned centerline to the south line of the Orange County Flood Control District right-of-way, commonly known as the C-4 channel; thence easterly along said south right-of-way line to point of beginning.

Drainage District No. 9. Beginning at the point of intersection of the centerline of Beach Boulevard with the centerline of Roosevelt Avenue; thence south 68° west to the intersection of the centerline of Hoover Street; thence northerly along last-mentioned centerline to the south line of the Orange County Flood Control District right-of-way, commonly known as the C-4 channel; thence westerly along said right-of-way to the intersection of the centerline of Golden West Street; thence southerly along last-mentioned centerline to the north line of the Orange County Flood Control District right-of-way, commonly known as the C-5 channel; thence westerly along said north right-of-way line to the intersection of the centerline of Beach Boulevard; thence northerly along last-mentioned centerline to the point of beginning.
J. 
Drainage District No. 10. Beginning at the point of intersection of the centerline of Garden Grove Boulevard with the centerline of Bolsa Chica Road; thence easterly along the centerline of Garden Grove Boulevard to northerly line of the Orange County Flood Control District right-of-way, commonly known as the C-3 channel; thence southerly along said right-of-way line to the centerline of Bolsa Chica Road; thence northerly along last-mentioned centerline to the point of beginning.

No building or portion thereof shall be constructed or added to, nor shall a permit for the construction of such building or addition thereto, or a change of use or occupancy from apartment house or duplex to a condominium, be issued for a Certificate of Use and Occupancy therefor be issued unless and until drainage fees for the local drainage district in which said property is located have been paid in accordance with the rates established by Section 13.24.020 of this code. The same limitations applicable to subdivisions shall be applied to drainage fees collected under this section, as set forth in Section 13.24.020.

The provisions of Sections 13.24.010 through 13.24.030 shall not apply to:
A. 
Erection of fences;
B. 
Erection of sunshade structures (patios), screened or unenclosed;
C. 
Interior alterations, including electrical, plumbing, heating and ventilating;
D. 
Any addition to an existing building, and construction of an accessory building in any zone, except as otherwise provided in subsection E below, unless the cumulative size of such addition to, or construction of, such building amounts to two hundred square feet or more in any twelve-month period;
E. 
Any addition to an existing building or construction of an accessory building on any property designed to be used, and which is used exclusively, as a single-family residence, unless the cumulative size to, or construction of, such building amounts to four hundred square feet or more in any twelve-month period.

When the area of the whole parcel of land exceeds seven thousand two hundred square feet and only a portion of said parcel is to be imposed by the construction of any building or the paving or surfacing of said parcel with any sealing material which decreases the natural percolation of surface water, the drainage fee may be computed on the actual area to be improved as herein set forth, but in no event shall the fee be less than the minimum fee for a parcel of land of seven thousand two hundred square feet in the district within which said land is located.

A. 
Whenever approval of the City of Westminster is required for any final tract map, approval shall be withheld until such time as the fees required by Section 13.24.020 have been paid in full. Approval of parcel maps shall not be withheld for the nonpayment of fees, but the same shall be collected in accordance with Section 13.24.030.
B. 
All fees paid pursuant to Section 13.24.020 shall be segregated into districts according to their source and deposited to a "Planned Local Drainage Facilities Fund," established for each local drainage district, and the moneys therein shall be expended solely for the construction or for reimbursement of construction of local drainage facilities within that district.
C. 
The city council may, at its discretion, accept real or personal property of equivalent value in payment of fees. The city may advance money from its general fund to pay the costs of constructing drainage facilities within a local drainage area and reimburse the general fund for such advance from the planned local drainage facilities fund for the local drainage area in which the drainage facilities were constructed. The city may further incur an indebtedness for the construction of drainage facilities within a local drainage district; provided, that the sole security for repayment of such indebtedness shall be moneys in the planned local drainage facilities fund for said district in which the drainage facilities were constructed.
