All dogs and cats must be provided with daily food sufficient for the breed and size to maintain the animal at a good level of nutrition, a shelter from the wind, cold and rain and a continuous source of clean wholesome water. Failure to provide any of the above by the owner, caretaker or custodian of the dog or cat shall be a violation of this article.

It shall be unlawful for any animal to be tied, staked, or tethered within the city on a tether shorter than ten feet (10') or with a weighted line or chain. It shall be unlawful for any animal to be tied, staked, or tethered upon any open or unfenced lot or land within the city so that the animal so tied, staked, or tethered could get on, across or within ten feet (10') of any street, park, or other public land, or within ten feet (10') of any sidewalk, public pass way, or building. If found in violation of this section, such animal so tied, staked, or tethered upon an open or unfenced lot shall be considered dangerous to the public in general and declared a nuisance, and shall be impounded as any other animal found running at-large.

It shall be unlawful for any person to abandon an animal in the city. An animal shall be considered abandoned if the owner leaves the animal without food or water for a period of 24 hours. Abandoned animals shall be impounded.

The owner of any animal that bites, scratches or attacks any person, when the person bitten was not trespassing upon the property of the owner of the animal, shall be guilty of violating this article.

It shall be unlawful for any person to maintain any pen, enclosure, pound or area for any animal in an unsanitary, offensive or disagreeable manner. The keeper of any pen shall be responsible for the pickup and disposal of all animal feces found in such pen. Feces must be removed often enough so that there is no odor or fly attraction to the enclosure, which would disturb a person of normal sensibilities or to constitute a health hazard to humans.

It shall be unlawful for an animal to be at large within the city. When an animal is found at large, and its ownership is verified by the animal control authority or any peace officer, the officer may exercise the option of serving the owner with a citation, and/or impounding the animal. The city shall establish a prima facie case by proving the ownership of the animal and that the animal was at large. The animal control authority or peace officer shall have the right to pursue and apprehend a free roaming animal onto private property without first requesting permission from the owner of the property or without obtaining a search warrant.

(a) 
It shall be the duty of the police chief to inspect any veterinary hospitals, pet shops, kennels, circus, animal shelter or facility once per month to ensure compliance with section 8-57.
(b) 
It shall be the duty of the police chief to keep, or cause to be kept, accurate and detailed records of the impoundment and disposition of all dogs, cats, and other animals coming into the city's custody, detailed records of all bite cases reported to the city, and the city's investigation of the same.
(c) 
The police chief may enforce any and all requirements of this division in any and all parts of the city as he may deem necessary to control the animal population and protect the health and safety of the citizens of the city.

(a) 
Any veterinary hospitals, pet shops, kennels, circus, animal shelter or facility set forth in section 8-4(b) shall ensure that:
(1) 
All animals are examined by a licensed veterinarian within seven days of being acquired and thereafter at least once every 30 days;
(2) 
All animals are kept in a sanitary and well ventilated area at all times;
(3) 
All animal pens are kept clean and capable of being inspected on a weekly basis. A minimum of 20 square feet for each dog and nine square feet for each cat must be provided;
(4) 
All animals which have been on the premises more than 25 days have been vaccinated;
(5) 
Records are kept for the acquiring, disposition, and destroying of each animal kept at said facility;
(6) 
No animals are destroyed or disposed of on the premises; and that all animals are available and visible during the monthly inspection by the police chief of the city.
(b) 
Failure to comply with this section may result in a denial or suspension of a permit to operate.
