No structure, edifice, building, or tower shall be installed
or built within the corporate limits or extraterritorial jurisdiction
of the city in excess of the following height without the approval
of the city council:

Any person, company, corporation, or other business entity wanting to exceed the height limitation as stipulated in section
10-205 above must file an application for a special exception as per section
10-235. Upon approval of a special expectation, an application for a building permit may be submitted.

Upon receipt of such application, the city secretary shall publish
a notice for a public hearing before the city council, providing a
time, date, and location. The notice shall be published in a newspaper
of general circulation within the city at least two weeks prior to
the scheduled hearing.

At the public hearing, the city council shall determine if the installation of a structure, edifice, building or tower in excess of in the height stipulated in section
10-205 above is in the best interest of the community as a whole, is of use and benefit to the citizens of the city, and is in a location not detrimental to the rest of the community. No building permit shall be issued unless the city council approves such a structure, edifice, building or tower in strict conformity with the provisions of the article. If the city council approves such structures in excess of the height stipulated in section
10-205 above, all other ordinances of the city shall be complied with.

All fees set forth by the applicable ordinances of the city
shall be paid prior to the installation or construction of any authorized
structure.

Any person or organization violating any of the provisions of this article shall be guilty of a misdemeanor and shall be fined as provided in section
1-13, and each day such violation shall be permitted to exist shall constitute a separate offense. The owners of any building or premises, where anything in violation of this article shall be placed or shall exist and any builder, contractor, agent, person or corporation employed in connection therewith, and who may have assisted in commission of any such violation shall be guilty of a separate offense and upon conviction thereof shall be fined as herein provided.
