Before any business license is issued to any person a written application shall be made by the business owner to the Business Services Coordinator. Such application shall be made under penalty of perjury and any material misrepresentations shall constitute a violation of this code. The application shall contain the following information:
A. 
The exact nature or kind of business for which the business license is requested.
B. 
The place where such business is to be carried on and if there is no permanent place of business, the residential address of the business owner.
C. 
Businesses that are required to be licensed by the County or State must provide verification of a current valid license.
D. 
Any further information which the Finance Department may require to issue the appropriate business license and to apprise other City departments whether the business is permitted in the City, whether it is permitted in the proposed location and whether any additional permits or licenses are required.
E. 
No business license shall be issued until the application has been reviewed by the Community Development Department, unless the Finance Department can determine from the face of the application that it requires no additional review.
F. 
In the event that the application for a business license is for a person doing business under a fictitious name, the application shall set forth the names and place of residence of those owning the business.

It is unlawful for any person to transact and carry on any business, trade, profession, calling or occupation in the City without first having procured a business license from the City to do so and without complying with any and all applicable provisions of this title. This section shall not be construed to require any person to obtain a business license if such requirement conflicts with state or federal law.

All business licenses, unless otherwise provided in this code, shall be prepared and issued by the Business Services Coordinator upon the payment to him or her of the sum required to be paid hereunder. Each business license issued shall state upon the face thereof the following:
A. 
The persons to whom the same is issued;
B. 
The kind of business and the location of the same;
C. 
The date of expiration of such business license.

A business license shall not be issued and may be revoked if the Business Services Coordinator has reason to believe that: (1) the applicant has not obtained all necessary land use approvals or permits; or (2) has failed to comply with any other regulations of this code having to do with the operation of the business for which the application has been made; or (3) is not authorized by this code, state or federal law to conduct the business for which application has been made; or (4) has reason to believe that the applicant has made a misrepresentation on the application. The issuance of a business license does not constitute a waiver of any other licensing, permit, zoning or other requirement contained in this code and does not entitle any person to conduct a trade, business or occupation in lieu of complying with any such requirements.

A. 
Manner of Payment. All business tax and processing fees shall be due and payable when application is filed for a business license.
B. 
Duration. A business license shall cover the period of one year from the first day of the month in which the business license is issued.
C. 
Gross Receipts. In the case of an original application for a business license which tax is based on gross receipts, the entire minimum fee shall be due and payable with application for the business license.
D. 
Flat Rate. All taxes based upon flat rate shall be due and payable in advance upon application for such business license.
E. 
For all business licenses based upon the optional provision of the tax by reason of having his or her business outside the City, the tax shall be payable in advance upon application for a business license and shall cover the period from the date of issue to one year from the first day of the month in which the business license is issued.

A separate business license must be obtained for each branch establishment or location of the business transacted and carried on and for each separate type of business at the same location, and each business license shall authorize the taxpayer to transact and carry on only the business taxed thereby at the location or in the manner designated in such business license; provided that any person conducting two or more types of businesses at the same location and under the same management, where all types of businesses so conducted are subject to tax based on gross receipts, may at his or her option pay only one tax fee calculated on all gross receipts of the businesses under the rate that applies to the type of business of such persons which requires the highest percentage payment of such gross receipts.

All business licenses must be kept and posted in the following manner:
A. 
Any taxpayer transacting and carrying on business at a fixed place of business in the City shall keep the business license posted in a conspicuous place upon the premises where such business is carried on.
B. 
Any taxpayer transacting and carrying on business, but not operating at a fixed place of business in the City, shall keep the business license upon his or her person at all times while transacting and carrying on such business, and upon demand said taxpayer must show said business license.

A duplicate business license may be issued by the Business Services Coordinator to replace any business license previously issued under this chapter which has been lost or destroyed upon the taxpayer filing a statement of such fact, and at the time of filing such statement paying to the Business Services Coordinator a duplicate business license fee in such amount as is established from time to time by resolution of the City Council.

A business license issued to conduct business at a particular place may, upon application and paying a fee in such amount established by resolution of the City Council, be amended to conduct such business at a new location.
