No person shall conduct the business of billiards, pool shooting or bagatelle, bowling excepted, within the City without obtaining a proper permit therefor, as provided in this chapter.

Application for a permit to carry on the business of billiards, pool or bagatelle shall be made to the Chief of Police upon forms to be furnished by the Business Services Coordinator. In addition to any other information which may reasonably be required by the Chief of Police, the application shall contain the information in Section 5.32.010.

The Chief of Police shall cause each applicant to be fingerprinted and photographed, a record of which shall be kept in the office of the Chief of Police. The applicant shall pay the amount set by the State for processing the fingerprints. The Chief of Police shall cause an investigation of each applicant to be made to determine if such applicant has committed any act that if done by a permittee would be grounds for revocation or suspension of a permit, or if such applicant has been convicted of a felony or any crime that has a substantial relationship to the permitted business.

The entrance into said rooms, at all times during business hours, shall be unlocked and unobstructed to all peace officers and to all members of the public.

No games of cards, dice or other games of chance shall be carried on in any room in which any of the businesses mentioned in Section 5.38.010 shall be conducted or in any room accessible therefrom.

A. 
No person having charge or control of any room where the games mentioned in Section 5.38.010 are being conducted, if alcoholic beverages are sold or consumed within the premises where said games are being conducted, shall permit any person under the age of 18 years to engage in any of said games or visit, enter or loiter in or about any room where said games are being conducted, except when such persons are accompanied by their parents.
B. 
No person under the age of 18 years shall engage in any of the aforesaid games or visit, enter, loiter in or around any room where the aforesaid games are being conducted, if alcoholic beverages are sold or consumed within the premises where the games are being conducted unless such persons are accompanied by their parents.

All billiard and poolroom businesses and other public places where games of skill or chance are played or operated in the City shall be closed between the hours of 2:00 a.m. and 6:00 a.m.

Each application shall be accompanied by a permit fee in such amount as is established from time to time by resolution of the City Council.
