A. 
Property alleged to have been stolen and coming into the custody of the county sheriff which is not offered in evidence and is not claimed by the owner thereof shall be disposed of in accordance with this section.
B. 
Such property shall be held by the sheriff for a period of three calendar months from the date it comes into the sheriff's possession. If satisfactory proof of ownership is not presented within that period, such property shall, with the consent of the district attorney, be transferred to the county purchasing agent for sale, or transferred to an online auctioneer for sale at public auction to the highest bidder, except as otherwise provided in this article.
C. 
Notice of such sale shall be given by the sheriff at least five days before the time fixed therefor by publication once in a newspaper of general circulation published in the county.

A. 
Personal property which comes into the possession of the sheriff's department property officer, and which is not considered "stolen," "embezzled" or "found property," shall be returned to the rightful owner in a timely manner.
B. 
Once a determination has been made that the property can be returned, a notice shall be mailed to the owner's last known address. The notice will give the owner 90 days in which to claim the property. If, at the expiration of 90 days, the property is unclaimed, and it is of the type that can be sold at public auction, it shall be transferred to the county purchasing agent for sale, or transferred to an online internet auctioneer for sale to the public at public auction and the proceeds thereof shall be paid over to the county treasurer for deposit to the general fund of the county, except as otherwise provided in this article.
C. 
If the property is of the type that would not normally be sold at auction, it shall be destroyed.
D. 
In the case of unclaimed bicycles and toys, the sheriff's department may dispose of such property by donating it to the county welfare department.
