It is unlawful for any person to keep or store, or permit the keeping or storing of, within any building or upon any premises, street or place in any village or town in the county outside the corporate limits of any incorporated city or town in the county, any gasoline, benzine, naphtha or hydrocarbon liquids which will flash or emit an inflammable vapor at a temperature below 110 degrees Fahrenheit, in quantities of more than five gallons, within 100 feet of any building of any other person, without first procuring from the board of supervisors a permit for such keeping or storing.

A. 
It is unlawful for any person to keep or store or permit the keeping or storing within any building or upon any street, place or premises except as hereinafter provided outside the corporate limits of any incorporated city or town and within a distance of 100 feet of a building of any other person in the county of any gasoline or other hydrocarbon liquids mentioned in Section 9.32.020, in quantities of more than 55 gallons, except and unless the same be stored underground in the following manner:
In a tank constructed of steel or iron, riveted and caulked or electric welded and coated with tar or other rust resisting material. Such tanks shall be buried outside the walls of the building, or under the sidewalk, the top of the same to be placed not less than two feet below the surface of and completely covered with at least two feet of earth; provided, however, that it shall not be necessary for the top of such tank to be more than 18 inches below the surface of the ground if the space above such tank is completely filled with earth and covered with cement concrete at least five inches in thickness and made impervious to all liquids. Such tanks shall be supplied with proper feed pipes and pumps, and each pump with an automatic cutoff.
B. 
The tanks shall be filled through a section of hose or pipe suitable for the purpose, directly connected with the tank delivery wagon, and which shall be detached from the feed pipe when not in service.
C. 
Gravity pressure or siphon process for taking oil from such tanks will not be permitted.
D. 
Tanks with a capacity of 300 gallons or more shall be equipped with a vent pipe which pipe shall extend at least six feet above the surface of the ground and shall be provided with a goose neck at the upper end thereof.

This part does not apply to gasoline and other hydrocarbon liquids herein mentioned while the same are in transit, nor to the use of portable tanks as approved by the fire underwriters, nor the carrying of inflammable liquids to the capacity of their tanks by motor vehicles.

Any person who violates any provision of this article shall be guilty of a misdemeanor.
