Weight limits established by state law and applicable to county highways are incorporated into and made a part of this article.

The director may in his or her discretion upon application in writing and if good cause appears, issue a special permit in writing authorizing the applicant to operate, drive or move over any county bridge or highway, a vehicle or combination of vehicles of any type or nature of a weight of vehicle and load exceeding the maximum specified pursuant to state law. This article shall not effect existing permits granted prior to this article.

Applications for such permit shall specifically describe the vehicle and load to be operated, driven or moved and the particular county bridge or highway over which the permit to operate is requested for a single trip or for continuous operation.

The fees for issuance of such permit shall be $2.50, for a permit authorizing more than one trip.

The director may issue or withhold such permit in his or her discretion or if such permit is issued to limit the number of trips, or to establish seasonal or other time limitations within which the vehicle described may be operated on the county bridge or highway indicated, or otherwise to limit or prescribe conditions of operation of such vehicle when necessary to assure against undue damages to the bridge or road foundations, surfaces, or structures, and to provide safe operation and traffic protection and may require such undertaking or other security as may be deemed necessary to protect the highways or bridges from injury or to provide indemnity for any injuries resulting from such operation.

Before any person shall drive or move or the owners shall cause or knowingly permit to be driven or moved on any county bridges or highways any vehicle whose total gross weight or dimensions thereof, exceeds the limits established by state law, such person or owners shall be required to first furnish a bond to the county in such amount as may be set by the director if it is deemed by the department of public works, or on appeal to the board of supervisors by the board of supervisors, to be necessary to protect the highways and bridges from injury or to operation of the vehicle.

Every such permit shall be carried in the vehicle or combination of vehicles to which it refers and shall be open to inspection of any peace officer at any time or any officer or employee charged with care or protection of such county bridges or highways. In the event that any person violates any of the terms or conditions of such permit or fails to display the permit, such action shall be cause and grounds for cancellation of the permit and in addition such person shall be punished as provided in Article 1.24 of this code.

Any peace officer is authorized to require the driver to stop and submit to a weighing of the same either by means of portable or stationary scales and may require such vehicle to be driven to the nearest scale facility.

Whenever an officer upon weighing a vehicle and load as provided above determines that the weight is unlawful, such officer may require the driver to stop in a suitable place and remove such portion of the load as may be necessary to reduce the gross weight of such vehicle to the limits as permitted by this article. All material so unloaded shall be cared for by the owner or operator of such vehicle at the risk of the owner or operator.

Any driver of a vehicle who fails or refuses to stop and submit the vehicle and load to a weighing, or who fails or refuses when directed by an officer upon a weighing of the vehicle to stop and otherwise comply with the provisions of this article shall be punished as provided in Article 1.24 of this code.

Any person violating the provisions of this article shall be liable for any or all damages and costs of repair which shall result from or be caused by the driving, operating, or moving of any vehicle upon any county highway or bridge.

It is unlawful for any person to drive or move or for the owner to cause or knowingly permit to be driven or moved, on any county bridge or highway any vehicle or combination of vehicles of any type or nature when the total gross weight of the same, including vehicle and load, exceeds the total weight limits provided in this article.

"Improved county highways" as used in this article shall mean all county highways and roads paved with cement, concrete, or asphaltic concrete, having a roadway of hard surface at least four inches thick made up of a mixture of rock, sand, or gravel bound together by an artificial binder other than natural soil. "Unimproved county highways" are all other county highways not improved.

The board of supervisors shall cause signs, indicating the maximum weight allowed, to be erected at all entrances to any county highways or bridges where the total gross weight is more restrictive than existing weight limits established by state law.
