The office of city manager of the city of Brentwood is created and established. Notwithstanding any provisions of the municipal code or other documents of the city to the contrary, wherever the words "administrative officer" "chief administrative officer," or "city administrator" are used, they shall mean city manager.

The city manager shall be appointed by the city council solely on the basis of his/her executive and administrative qualifications and ability. Residence in the city of Brentwood shall not be required as a condition of employment. However, no later than one year after employment, the city manager shall reside within the area of the former boundaries of the East Contra Costa Fire Protection District, as those boundaries existed on September 23, 2014. Upon the city manager's showing of a good faith effort to relocate pursuant to this section, the city council may, by motion, extend the one year relocation period. No member of the city council shall receive such appointment during the term for which he/she shall have been elected or within one year after the expiration of his/her term of office.

Unless otherwise specified in a separately executed employment agreement, the city council shall appoint the city manager for an indefinite term and may remove him or her at any time by a four-fifths vote of the city council. Notwithstanding this provision, however, the city manager shall not be removed from office during or within a period of ninety days next succeeding any general municipal election held in the city at which election a member or members of the city council is elected, or within a period of ninety days next succeeding the appointment of any member or members to the city council.

The city manager shall secure a corporate surety bond in the amount of one hundred thousand dollars, or such other sum as may be determined by the city council and shall be conditioned on the faithful performance of the duties herein prescribed. The fee will be paid by the city of Brentwood.

The city manager, or such person designated to perform his or her duties as provided in Section 2.36.060, shall receive such compensation and benefits as the city council shall from time to time determine and fix, and the compensation shall be a proper charge against such funds of the city that the city council shall designate. The city manager shall be reimbursed for all sums necessarily incurred or paid by him or her in the performance of his or her duties, or incurred when traveling on business pertaining to the city under direction of the city council.

The city manager shall appoint, subject to the approval of the city council, one of the department heads of the city to serve as manager pro tempore during any extended temporary absence or disability of the city manager. In case of the absence or disability of the city manager and his or her failure to so appoint a manager pro tempore, the city council will designate any qualified person to perform the duties of the city manager.

The city council and its members shall deal with the administrative service solely through the city manager. This requires that neither the city council nor any individual member shall give any direct orders to any of the subordinates of the city manager. However, this is not meant to impede or restrict access by any city council member to city staff for the purpose of collecting information they feel they need to do their job as an elected official. Specific requests for such information should be directed to department heads.

The city manager shall be the administrative head of the city government under the direction and control of the city council, except as otherwise provided in this chapter. He or she shall be responsible for the efficient administration of all the affairs of the city which are under his or her control. In addition to his or her general powers as administrative head, and not as a limitation thereon, it shall be his or her duty and have the power:
A. 
To enforce all laws and ordinances of the city and to insure that all franchises, contracts, permits and privileges granted by the city council are faithfully performed and observed;
B. 
To appoint, suspend, remove, promote and demote any and all officers and employees of the city, except the city attorney and city council appointed boards and commissions;
C. 
To supervise in general the operations of all departments of the city and to control, order and give directions to all heads of departments and to subordinate officers and employees of the city under his or her jurisdiction through their department heads;
D. 
To reorganize offices, positions, departments or units under his or her direction as may be indicated in the interest of efficient, effective and economical conduct of the city's business;
E. 
To analyze the functions, duties and activities of the various departments, divisions and services of the city government and of all employees thereof, and to effect changes to departments, divisions and services under his or her direction, including updating of classification titles, descriptions, salary ranges and leave adjustments that in his or her judgment will result in the highest degree of efficiency in the overall operation of the city government;
F. 
To attend all meetings of the city council unless excused therefrom by the city council;
G. 
To recommend to the city council for adoption such measures and ordinances as he or she deems necessary or proper;
H. 
To keep the city council at all times fully advised as to the financial conditions and needs of the city, and to make recommendations thereon;
I. 
To prepare and submit an annual city budget to the city council for its approval;
J. 
To compile and keep up to date a complete inventory of all property, real and personal, owned by the city;
K. 
To approve all expenditures of the city before they are presented to the city council;
L. 
To purchase or cause to be purchased all supplies and equipment for all of the departments or divisions of the city;
M. 
To make investigations into the affairs of the city, and any department or division thereof, and any contract, or the proper performance of any obligations of the city;
N. 
To investigate all complaints in relation to matters concerning the administration of the city government and in regard to the service maintained by public utilities in the city;
O. 
To exercise general supervision over all public buildings, public parks and other public property which are under the control and jurisdiction of the city;
P. 
To sign or designate to be signed:
1. 
Checks drawn upon the city treasury,
2. 
Written contracts and/or conveyances made or entered into by the city or approved by direction of the city council,
3. 
Instruments requiring the city seal;
Q. 
To serve as city clerk, director of emergency services, finance officer, personnel officer, and purchasing officer. The city manager may delegate all or portion of the duties of each of these positions to other city employees;
R. 
To perform such other duties and exercise such other powers as may be delegated to him or her from time to time by the city council;
S. 
To devote his or her entire time to the duties of his or her office and the interest of the city, except as may otherwise be approved by the city council.
T. 
To adjust the amount of processing fees; find alternative means of paying processing fees; extend the time for payment of processing fees; and/or make refunds or prorations of processing fees paid. Such action shall only be for any business, or activity of any institution or organization recognized by a tax board of the state with a "Statement of Domestic Non-Profit Organization," or the Federal Internal Revenue Service as being conducted wholly for the benefit of charitable, religious, or nonprofit purposes and from which profit is not derived, either directly or indirectly, by any individual or organization. Such action shall only be taken for good cause shown.
U. 
To determine the processing fees appropriate for projects that do not fit within the typical and regular processing fee categories listed in the fee resolutions and ordinances of the city.
V. 
Nothing in this section shall be construed to affect the city's discretion, upon proper application for senior housing, congregate care facilities or affordable housing pursuant to Government Code Section 65915, and/or Municipal Code Chapter 17.725, to adjust related development fees.

The city manager shall take orders, directions and instructions regarding policy from the city council only when sitting in a duly held meeting of the council.

It shall be the duty of the city attorney, and all subordinates of the city manager, to assist the city manager in administering the affairs of the city efficiently, economically and harmoniously so far as may be consistent with their duties as prescribed by law and ordinances of the city. All employees of the city shall deal with the city council solely through the city manager. This is not meant to restrict or limit contact and communication from city staff to the city council. Specific requests by city council for information they feel they need to do their job as an elected official should be directed to department heads.

The city manager may attend any and all meetings of boards and commissions created by the city council, upon his or her own volition or upon direction of the city council. At such meetings which the city manager attends, he or she shall be heard as to all matters upon which he or she wishes to address the members thereof, and he or she shall inform the members as to the status of any matter being considered by the city council. The city manager shall cooperate to the fullest extent with the members of all boards or commissions appointed by the city council.

Nothing contained in this chapter shall prohibit inquiry or social communications between members of the city council, boards and commission, and the city manager and city employees of the city at any time.
