Proceedings to open a public street which has not previously been officially opened for vehicular traffic are initiated by the Council on its own initiative or by any abutting property owner by filing an application with the City Recorder on forms provided by the Recorder. A filing fee of $150 shall accompany the application. The City Recorder shall refer the application to the Public Works and Streets Committee (hereafter "committee").

A. 
Following review of the application by the committee, the committee shall determine whether the opening of the street as proposed is in the public interest. The committee may recommend conditions to the opening of a public street to ensure protection of adjacent property owners, public utilities, and proper installation of improvements sufficient to safely handle traffic volumes of the opened road. The application and recommendations shall be forwarded to the City Council.
B. 
If the committee concludes that the opening of the public street is in the public interest and proceedings are initiated by an application signed by the acknowledged signatures of 100% of abutting property owners, the Council may proceed to approve the opening of the street. If the application is not acknowledged by 100% of the property owners abutting the portion of the street to be opened, or if the Council concludes that the opening of the street is not in the public interest, or if the Council determines that a public hearing is necessary, a public hearing shall be held by the City Council.
C. 
The procedure for the notice and conduct of any public ordinance pursuant to this ordinance shall be the same as for a quasi-judicial hearing held pursuant to Title 9.
