Proceedings to vacate a public street right-of-way requested by any abutting property owner shall be initiated by filing an application for consideration with the City Recorder on forms provided by the Recorder. A filing fee of $250 shall accompany the application. The City Recorder shall refer the application to the Public Works and Streets Committee and, if necessary, the Planning Commission (hereafter "committee") for initial review. Any costs related to said vacation application and petition process over and above the initial fee shall be paid in full by the applicant.

A. 
Following review of the application by the committee, the committee shall determine whether the vacation of the street as proposed is in the public interest and if there appears to be no reason why the applicant should not commence the petition process. In reviewing the application the committee shall determine if vacating the right-of-way would adversely effect the general vehicular or pedestrian traffic circulation system of the City and where current or future water and sewer lines and easements are or will be necessary.
B. 
The City shall notify the applicant of the committee's determination. The determination made by the committee shall not be considered to be a recommendation to City Council, nor shall it be considered by the applicants to be the final determination of the City. Applicants may choose whether to rely on the committee's determination in making their decision to pursue the petition process. Following notification, applicants who choose to pursue the vacation shall proceed with the vacation process as set forth in current Oregon Law (Oregon Revised Statutes) Sections 271.005 to 271.230.
C. 
Petitions submitted with sufficient consent by the owners of abutting and area property shall be presented to City Council. The Council may deny the petition after notice to the petitioners, or if there appears to be no reason why the petition should not be allowed in whole or in part, the Council shall fix a time for a formal hearing upon the petition.
