For the purposes of this Chapter, the following words and phrases shall have the meanings respectively ascribed to them by this Section:
means a dog or cat that has been spayed or neutered.
means any County employee designated by resolution of the County Board of Supervisors as primarily responsible for animal control and regulation.
means the County of Santa Barbara Animal Services program.
means the County employee designated by the County Board of Supervisors as the County employee responsible for the administration and operations of Animal Services.
means Monday through Friday, not including City and County holidays.
means the County of Santa Barbara and includes Animal Services.
means the person responsible for caring for and looking after the dog on behalf of the owner of the dog.
means a "restricted dog" or a "vicious dog."
means the Animal Services Director, or designee.
means the Health Officer of the City and his or her duly appointed deputies, and shall also mean and include the Health Officer of the County and any County employees to whom he or she has delegated any responsibilities in the event the Animal Services Director serves as Health Officer of the City pursuant to agreement between the City and County.
means under the control and in the possession of the City.
means the owner of a dog or cat.
means Animal Services, the Animal Services Director, or the Supervising Animal Control Officer as appropriate in the context, or any other organization described in this Chapter as suitable to perform the services of Poundkeeper if applicable.
means:
Any dog which when unprovoked, engages in any behavior that requires a defensive action by a person to prevent bodily injury to any person, domestic animal or livestock, off the property of the owner or custodian of the dog; or
Any dog which, when unprovoked, bites a person or otherwise engages in aggressive behavior when off the property of the owner or custodian of the dog, causing an injury that is less severe injury than as defined as "severe injury to a human" in Section 5-3.101(q); or
Any dog which, when unprovoked, has inflicted an injury less severe than a "severe injury to an animal," as defined in Section 5-3.101(r), to a domestic animal or livestock off the property of the owner or custodian of the dog; and
Any dog for which an administrative hearing has been held and the dog has been determined to need to be closely controlled by the owner or custodian and restrictions have been designated by a hearing officer with jurisdiction in the County of Santa Barbara.
means an animal being held under City or County authority pending completion of legal proceedings.
shall mean the person having charge of one or more publicly owned facilities within Santa Barbara County capable of humane seizure of animals.
means any physical harm to a human being that results in a serious illness or injury, including but not limited to a fracture, muscle tears or disfiguring lacerations requiring sutures or corrective or cosmetic surgery.
means physical harm to a domestic animal that results in a serious illness or injury, requiring veterinary treatment for such injuries, including, but not limited to, fracture repairs, suturing of lacerations, internal injuries requiring surgery, and injuries ultimately resulting in the death or euthanasia of the animal.
means a dog or cat that has not been spayed or neutered.
means:
Any dog that engages in or has been found to have been trained to engage in exhibitions of illegal fighting; or
Any dog which, when unprovoked, in an aggressive manner, inflicts severe injury to a human, as defined in Section 5-3.101(q), or kills a person; or
Any dog that kills or inflicts a severe injury on another domestic animal or livestock a severe injury to an animal as defined in Section 5-3.101(r), when the killed or injured animal is properly contained on the property of its owner or custodian or is being lawfully walked on leash by its owner or custodian or is physically under the control of the owner or custodian (such as being held in the arms of the owner or custodian); or
Any dog that has exhibited the behaviors defined under "restricted dog" (1), (2), or (3) above and that has a documented prior history of such behaviors in Animal Services database or the records of another jurisdiction, which may include, but is not limited to, a prior warning following investigation of an incident, a documented bite to a human, or a determination that the dog is vicious or potentially dangerous pursuant to Chapter 9 of Division 14 of the California Food and Agricultural Code; or
Any dog previously determined to be and currently designated as a restricted dog in the City of Santa Maria or Santa Barbara County, which, after its owner or custodian has been notified of this determination, continues the behavior that resulted in designating it a restricted dog, engages in other behavior described in the "restricted dog" definition in Section 5-3.101(n), or is maintained in violation of an administrative decision, a court order, or restrictions placed on it; or
Any dog designated to be dangerous or vicious in another jurisdiction which exhibits any of the behavior(s) defined in (1), (2), or (3) above.
