(a) 
No minor shall be in or upon any street, highway, park, alley or other public place between the hours specified in this chapter, unless such minor is:
(1) 
Accompanied by a parent, guardian or other person twenty-one years of age or older and authorized by the parent or by law to have care and custody of the minor;
(2) 
Then engaged in a lawful pursuit or activity which requires such a minor to be present in such public places during the hours specified in this chapter; or
(3) 
Emancipated pursuant to ORS 109.550 through 109.565.

No parent, guardian or person having the care and custody of a minor under the age of eighteen years shall allow such minor to be in or upon any street, highway, park, alley or other public place between the hours specified in Section 7.44.025, except as otherwise provided in that section.

(a) 
For minors under the age of 14 years, the curfew is between 9:15 p.m. and 6:00 a.m. of the following morning, except on any day immediately preceding a day for which no public school is scheduled in the City, the curfew is between 10:15 p.m. and 6:00 a.m. of the following morning.
(b) 
For minors 14 years or age or older, the curfew is between 10:15 p.m. and 6:00 a.m. of the following morning, except on any day immediately preceding a day for which no public school is scheduled in the City, the curfew is between 12 midnight and 6:00 a.m. of the following morning.

Any minor who violates a provision of this chapter may be taken into custody as provided in ORS 419C.080, 419C088 and may be subjected to further proceedings as provided in ORS Chapter 419C.

Violation of Section 7.44.020 shall be a Class C misdemeanor.
