(Prior code § 20-22; Ord. 232 § 2, 1968)
No person shall harbor, own or keep any vicious dog within the
city. A vicious dog is any dog which, when unprovoked and off the
property of the owner or keeper of the dog, on one or more occasions,
bites a person causing severe injury or kills a person. Vicious dog
also includes any dog which, when unprovoked and off the property
of the owner or keeper of the dog, on two or more separate occasions
within a thirty-six-month period, has killed or inflicted injury by
attacking or biting a domestic animal, engages in behavior that requires
a defensive action by any person to prevent bodily injury, or has
bitten a person causing less than severe injury. Severe injury means
any physical injury to a person that results in muscle tears or disfiguring
lacerations or requires multiple sutures or corrective or cosmetic
surgery. The poundmaster is directed to impound such dog or dogs pending
the direction of the court. The person found in violation of this
section shall be held personally liable to the city for the related
administrative costs incurred by the city to abate the vicious dog.
The city reserves its right to use any other legal remedies to collect
costs or damages.
