A. Purpose.
The purpose of this chapter is to improve public health, safety, and
general welfare by increasing residential energy efficiency and reducing
carbon (greenhouse gas) emissions by: encouraging voluntary residential
energy efficiency assessments for existing dwelling units (i.e., those
dwelling units permitted prior to the energy efficiency standards
in effect on November 1, 2002); converting those assessments into
actual energy efficient residential retrofits; and tabulating the
results of the energy efficiency and greenhouse gas emission reductions
as part of the overall emissions reduction target to be established
as part of the anticipated Stockton Climate Action Plan. The City
of Stockton must comply with Assembly Bill 32 (AB 32), the Global
Warming Solutions Act of 2006, which requires a reduction in greenhouse
gas emissions to 1990 levels by 2020. This chapter will be a tool
to implement the above noted legislation as well as comply with the
requirements of the California Environmental Quality Act, and the
goals, objectives, policies, and strategies established in the Stockton
General Plan. This chapter will be reviewed a minimum of every five
years. It is the intent of this chapter to establish regulations that
are equally or more stringent than the requirements of State law.
Unless specifically prohibited by State law, requirements established
by this chapter that are more stringent than State law shall be given
full effect.
B. Objective.
Consistent with the State of California Assembly Bill 32 Scoping Plan
guidelines outlined by California Air Resources Board, the City's
objective is to reduce greenhouse gas emissions of the City's existing
dwelling units (those permitted prior to November 1, 2002, excluding
unconditioned detached structures) by completing: 1,500 residential
energy efficient retrofits in 2011, 3,000 residential energy efficient
retrofits in 2012, and 4,000 residential energy efficient retrofits
in 2013. The target of the voluntary program is to reduce energy use
and greenhouse gas emissions by 25 percent in these retrofitted dwelling
units. The Green-Up Stockton program will be voluntary as long as
retrofit goal of 8,500 units is achieved. In the event that the retrofit
goal of 8,500 retrofits is not met by December 31, 2013, then, beginning
on July 1, 2014 applicable residential units (those permitted prior
to November 1, 2002, excluding unconditioned detached structures)
will be required to have an "energy assessment."

A. To

Stockton with a goal of accomplishing: 1,500 residential energy efficient
retrofits in 2011, 3,000 residential energy efficient retrofits in
2012, and 4,000 residential energy efficient retrofits in 2013.
B. The
goal of completing a total of 8,500 residential energy efficient retrofits
by December 31, 2013, with a target to achieve an average 25 percent
reduction in energy use for the retrofitted units.
C. If the 8,500 unit retrofit goal is met by December 31, 2013 (subsection
B of this section), beginning January 1, 2014, and for each calendar year thereafter, a goal of retrofitting four and one-half (4.5) percent of all applicable remaining dwelling units is established (those permitted prior to the Energy Efficiency Standards in effect on November 1, 2002, and excluding unconditioned space). If the four and one-half (4.5) percent retrofit goal is not met by December 31st of each calendar year then, beginning on July 1st the following year all applicable residential units (those permitted prior to November 1, 2002, excluding unconditioned space) shall be required to have an "energy assessment" completed as outlined by the California Energy Commission's (CEC) Home Energy Rating System II (HERS II). The energy assessment shall be performed by a CEC certified Home Energy Auditor or by a Building Performance Institute (BPI) Certified – Analyst, or another means deemed acceptable by the City of Stockton. This requirement shall be triggered at the time and by criteria as deemed appropriate by the City Council.
D. If
the 8,500 unit retrofit goal is not met by December 31, 2013, then,
beginning on July 1, 2014 all applicable residential units (those
permitted prior to November 1, 2002, excluding unconditioned space)
shall be required to have an "energy assessment" completed as outlined
