The board of supervisors finds and declares:
A. 
The Appellate Courts of the state of California have held that an ordinance which imposes a duty on a governmental entity to enforce the ordinance can impose liability upon such governmental entity in the event of failure to enforce the ordinance unless the entity's intent not to impose self-liability has been clearly stated.
B. 
Each of the several provisions of this code, and each other county enactment, presently enacted or hereafter enacted, which imposes a duty on county officers, agents, and employees to enforce such enactment is intended to impose a discretionary duty whether or not enforcement appears to be mandatory by use of the word "shall" or similar language.
C. 
It is the intent of the board of supervisors that, unless expressly provided otherwise, Section 1.05.020 shall be applicable to all enactments of the county, presently enacted and hereafter enacted, thereby making it unnecessary to include such provision in each and every such enactment.

Nothing in this code, nor in any other county enactment, is intended to impose liability upon the county, or any of its officers, agents, or employees, for any injury to persons or damage to property alleged to result from any act or omission by the county or any of its officers, agents, or employees beyond the liability imposed by the laws of the state or the United States, and no such enactment shall be so construed. Nothing in this code, nor in any other county enactment, is intended to impose a mandatory duty upon the county or any of its officers, agents, or employees for the purpose of determining entitlement to equitable relief or liability for any injury to persons or damage to property alleged to result from the failure of the county or any of its officers, agents, or employees to discharge a duty imposed by any county enactment, and no such enactment shall be so construed.

No officer, agent or employee of the county, other than the board of supervisors, shall make an enactment expressly providing that any officer, agent, or employee of the county shall have a mandatory duty to enforce such enactment, or any other county enactment. Only the board of supervisors shall have authority to impose liability on the County of Stanislaus or its officers, agents, or employees, by enactment or otherwise.

For the purposes of this chapter:
A. 
"Agent" means any person not a county employee who performs services for or on behalf of the county pursuant to a contract with the county, or any board, commission, committee or advisory body of the county and includes the members of each of them.
B. 
"County enactment" means any ordinance, resolution, policy, regulation, directive, rule, decision or other enactment adopted, enacted, promulgated, made or approved either explicitly or implicitly by the board of supervisors or any decision or administrative policy regulation or directive made or promulgated by any authorized county officer, agent or employee.
