In accordance with the authority contained in Part 7, Chapter 10 (commencing with Section 10900) of the Education Code, there is established a board of commissioners consisting of seven members, to be known as the county park commission. Of the seven members there shall be appointed one resident of each of the five supervisorial districts of the county and two members appointed from the county at large.

The members of the park commission shall be appointed by the board of supervisors for four-year terms. The appointments of members of the park commission shall be so made that the terms of not more than two members will expire each year.

All of the members of the park commission shall serve without compensation, except that they shall be entitled to be reimbursed for their reasonable traveling expenses.

The park commission shall organize by electing one of its members chairperson and one member vice-chairperson. It shall also elect a secretary, who need not be a member. The officers of the park commission shall be elected on the last regular meeting of each calendar year for a term of one year.

The park commission shall establish a time and place for regular meetings which shall be held at least once every two months. Special meetings may be held upon the call of the chairperson.

The majority of appointed park commissioners shall constitute a quorum for the transaction of business by the park commission, but a lesser number may convene from time to time. In the event that two member vacancies on the park commission exist simultaneously, then a quorum shall consist of a majority of the currently serving members.

The park commission shall have the following powers and duties:
A. 
It shall have charge of promoting and encouraging all matters of public recreation, whether specified in this chapter or not, including the proposing to the board of supervisors of sites for playgrounds and summer camps;
B. 
It shall make recommendations with a view to the acquisition and maintenance of suitable playgrounds for children and recreation centers for the public;
C. 
It shall make recommendations to the board of supervisors for the maintenance and operation of all public parks, campgrounds and picnic grounds owned or controlled by the county;
D. 
It shall recommend to the board of supervisors the extent and conditions under which the county should cooperate with other public authorities in developing and conducting community recreation; and
E. 
It shall adopt rules and regulations for its proceedings and for such other purposes as may be helpful in the carrying on of a park and recreation program under its supervision.

The parks and recreation director is appointed in accordance with Stanislaus County Code Section 3.16.060. The parks and recreation director, when required by the park commission, shall attend all meetings of the park commission and shall make such reports to the park commission or to the board of supervisors, as shall be required of him or her from time to time.

After a member of the park commission fails to attend three consecutive meetings, unless excused by the majority vote of the commission, his or her membership thereon shall be automatically terminated and a successor shall be appointed by the board of supervisors to serve for the unexpired portion of the term.

A. 
The board of supervisors shall annually allocate for park and recreation purposes the proceeds from all gifts, legacies or bequests received for said purposes.
B. 
All moneys so allocated shall be used for the purpose of public parks and recreation, including the acquisition of sites for playgrounds, public parks and recreation equipment, and for the operation and maintenance of public parks and playgrounds and for the payment of salaries of persons employed for said work.
