Based on information presented by the Stanislaus County Law Library and its board of trustees, this board finds and declares:
The costs associated with the continued operation of the Stanislaus County Law Library have risen over the last several years. Court filing fees, which are the main source of law library funding, have declined during that same period. The costs of operating the Stanislaus County Law Library have exceeded funding for the past two years, which has required using reserves. On June 16, 2004, the board of trustees of the Stanislaus County Law Library decided to recommend the raising of court filing fees to increase the law library's share of court filing fee proceeds by three dollars from the present fees of fifteen dollars, thirteen dollars, and seven dollars to fees of eighteen dollars for filing complaints and appeals, sixteen dollars for filing answers and ten dollars for filing small claims appeals.
Section 6322.1 of the California Business and Professions Code authorizes the proposed increase in the county law library court filing fees. State law also authorizes this board to exclude these filing fees from the definition of "total filing fee" in Government Code Sections 26820.6 and 72055, in order to implement the fee increase without reducing funding available for court administration expenses. The proposed fee increases have been duly noticed as required by state law.

Effective January 1, 2005, the amounts collected as filing fees in civil cases by the Stanislaus County Superior Court clerk and deposited into the Stanislaus County Law Library trust fund/account shall be increased by three dollars, to eighteen dollars for filing complaints, appeals, and other documents to commence or remove any civil action, and to ten dollars for filing small claims appeals, both such increases being authorized by Section 6321 of the Business and Professions Code, and to sixteen dollars for filing answers or other "first appearance" documents in civil actions pursuant to Section 6322 of the Business and Professions Code.
As authorized by Business and Professions Code Sections 6322.1, each of the foregoing law library fees shall be excluded from the definition of "total filing fees" and/or "total fee" as those terms are used in Government Code Sections 26820.6 and 72055.
The Stanislaus County court executive officer is authorized and directed to raise the superior court filing fees in accord with each event identified in the Business and Professions Code at Sections 6321 and 6322 to provide for the additional three dollars per filing to be allocated to the Stanislaus County Law Library trust fund/account with such fee increases to take effect January 1, 2005.

Pursuant to Section 6322.1 of the Business and Professions Code, the board of supervisors hereby adjusts the apportionment of uniform filing fees listed in Section 6321 of the Business and Professions Code to increase the amount distributed to the Stanislaus County Law Library trust fund, as set forth below, to defray expenses of the Law Library:
A. 
Effective January 1, 2014, the amount distributed to the Law Library trust fund shall be increased by the amount of three dollars over the present fees of twenty-four dollars.
B. 
Effective January 1, 2015, the amount distributed to the Law Library trust fund shall be increased an additional three dollars.
