It is unlawful for any person to burn or cause to be burned
any garbage, waste, packing material, trash, discarded boxes or other
material, outside of an approved incinerator, within the town limits
except when a variance from burning has been granted to the town by
the Wyoming state department of environmental quality, it being understood
that a variance is normally granted for specific days in the spring
and in the fall of each year.

Upon receiving a variance from the Wyoming state department
of environmental quality, the town clerk-treasurer shall publish in
the Basin Republican Rustler, a notice setting forth the days on which
authorized burning shall be permitted in the spring and in the fall.

Recreational burning, such as open burning for recreation, cooking
of food and providing warmth and entertainment for humans, shall be
allowed within the town limits, unless otherwise restricted by the
state, county or town, from time to time. Recreational burning includes
any fire combustion occurring in a fire pit, outdoor fireplace, chiminea
or grill. The following shall be adhered to during any recreational
burning:
A. All fires
shall be within a properly contained area.
B. Only dry,
well-seasoned firewood or similar clean burning wood shall be allowed.
Trash burning is prohibited.
C. Fires must
be at least 15 feet from the nearest neighbor's property line.
D. All burning
shall avoid, as much as possible, undue smoke and odor and shall be
conducted in such a manner to avoid disturbing neighboring properties.

Any person violating the provisions of this chapter shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be subject to penalty as provided in Section
1-4-1 of this code.

It is unlawful for any person, whether as owner, tenant, agent
or servant, or in any capacity whatsoever, to deposit or cause to
be deposited, any ashes, cinders or live coals in any street or alley
or upon any lots or premises within the corporate limits of the town.

It shall be the duty of the owners of all premises within the
corporate limits of the town to place or cause to be placed upon their
respective premises, suitable receptacles for the deposit of ashes,
cinders or live coals as enumerated. Such receptacles shall be constructed
of brick, stone or sheet iron and shall be provided with metallic
covers or gates.

The contents of such receptacles shall be carried away at the
expense of the users.
