The City Manager and acting City Manager must furnish a corporate
surety bond to be approved by the City Council in such sum as may
be determined by the City Council, and must be conditioned upon the
faithful performance of the duties imposed on the City Manager and
acting City Manager as herein prescribed. Any premium for the bond
is a proper charge against the City. This bond requirement may be

any temporary absence or disability of the City Manager. In case of
the absence or disability of the City Manager and a failure to appoint
someone to perform the duties of the City Manager, the Council may
designate a duly qualified person to perform the duties of the City
Manager during the period of absence or disability of the City Manager.
(Ord. 555 § 3, 2019)

may dictate, to sign documents specified in Section 40602 of the California
Government Code whenever such documents have been approved by the
City Council for execution by resolution, motion, minute order or
other appropriate action;
L. Pursuant to
Government Code Section 935, reject, allow, compromise, or settle liability claims against the City in amounts not to exceed, per claim, the City Manager's contract authorization in Chapter
3.24. The City Council has sole authority to reject, allow, compromise, or settle liability claims against the City exceeding the City Manager's authorized amount;
M. Perform
such other responsibilities and exercise such other powers as may
be delegated to the City Manager from time to time by ordinance or
resolution or other official action of the City Council.
(Ord. 555 § 3, 2019)
Notwithstanding the provisions of Section
2.04.010 of this chapter, the City Manager must not be removed from office, other than for misconduct in office, during or within a period of 90 days after any general municipal election held in the City at which a member of the City Council is elected or when a new City Council member is appointed; the purpose of this provision is to allow any newly elected or appointed member of the City Council or a reorganized City Council to observe the actions and ability of the City Manager in the performance of the powers and duties of the office. After the expiration of the 90-day period aforementioned, the provisions of this chapter as to the removal of the City Manager will apply and be effective. The removal of the City Manager shall be effected only by a majority vote of the whole council (three votes).
(Ord. 555 § 3, 2019)
Nothing in this chapter may be construed as a limitation on
the power or authority of the City Council to enter into any agreement
with the City Manager delineating additional terms and conditions
of employment not inconsistent with any provisions of this chapter.
