It is unlawful for any person, or for any person as agent, clerk or employee, within the corporate limits of the City to operate, maintain, or offer for public use within the City any circus or carnival without first having procured a business license required by Chapter 4.02 and a regulatory permit required by Chapter 4.03.

Upon receipt of an application to operate or exhibit a circus or carnival on City property with or without paid admissions, the issuing officer may issue a permit not to exceed one year only after determining that all of the following are satisfied:
A. 
The use not be in violation of any zoning ordinance of the City;
B. 
The location and type of equipment are approved by the Engineering Department and the Community Services Department;
C. 
A current certificate of inspection has been issued by the State of California for each amusement ride to be operated within the carnival; and
D. 
The applicant has the insurance required by this chapter.

Upon receipt of an application to operate or exhibit such carnival on private property, the issuing officer issues a permit for the entire time of the carnival or for one year, whichever is the lesser period of time after determining that all of the following are satisfied:
A. 
The carnival complies with the requirements of the zoning ordinance;
B. 
The location and type of equipment are approved by the Planning and Building Department and the Community Services Department;
C. 
The applicant has satisfied the insurance requirements of this chapter; and
D. 
The State of California has issued a current certificate of inspection for each amusement ride to be operated within the carnival.

The operator of every circus and carnival must obtain and maintain in full force and effect insurance in the types and amounts to the satisfaction of the City Manager and, if a special event permit is required, satisfactory to the Director of Planning and Building.
