The city shall not regulate the grantee's rates for any class
of cable service during the time period and to the extent that rate
regulation is prohibited under the federal or state law. The city
reserves the right to institute any rate regulation system permitted
by law. The city may adopt such a rate regulation system by amendment
to the franchise ordinance, provided, however, that nothing contained
herein shall be deemed a waiver of the grantee's rights to challenge
any rate regulation system adopted by the city on constitutional or
other applicable grounds.
