(a) 
Subject to the exception set forth in subsection (b) of this section, it is unlawful for any person, firm, entity, partnership or corporation to sell, use or discharge any fireworks within the city, including, but not limited to, "safe and sane" fireworks as that term is defined in Part 2 of Division 11 of the California Health and Safety Code, as the same may be amended from time to time hereafter.
(b) 
Exception. Nothing in this chapter shall preclude the presentation of a licensed public display of fireworks including, but not limited to, "safe and sane" fireworks.

The violation of any of the provisions of this chapter shall constitute a nuisance and may be abated by the city through civil process by means of restraining order, preliminary or permanent injunction or in any other manner provided for by law for the abatement of nuisances.

Any person, firm, entity, partnership or corporation, whether as principal, agent, employee or otherwise, violating or causing the violation of any of the provisions of this chapter shall be guilty of a misdemeanor, and any conviction thereof shall be punishable by a fine of not more than one thousand dollars or by imprisonment for not more than six months, or by both such fine and imprisonment. Any violation of the provisions of this chapter shall constitute a separate offense for each and every day during which such violation is committed, permitted, caused or continued.
