It is unlawful for any person residing in the city to operate or use a bicycle upon the streets and rights-of-way of the city unless a bicycle is licensed to the owner in accordance with this chapter. As used herein, the term "bicycle" also includes "motorized bicycle" as defined by the California Vehicle Code. Every person who violates any provision of this section is guilty of an infraction, unless the violation is otherwise made a misdemeanor pursuant to subsection 1.01.110(b) of this code.

The police department or its designated agent shall issue bicycle licenses upon written application therefor. Such licenses shall be valid for a period of three calendar years, including the year of registration, and shall expire on December 31st of the third year of the registration period.

Bicycle licenses when issued shall entitle the licensee to operate the bicycle for which the license has been issued upon all streets, alleys and public highways, exclusive of the sidewalks thereof, in the city.

The license fee to be paid for each new bicycle license shall be six dollars, and such fee shall be paid in advance. All license fees collected under this title shall be paid into the general fund of the city. Such fees shall be used by the city to support the carrying out of the provisions of this chapter, to improve bicycle safety programs within the city, and to establish, as the same shall be deemed necessary and desirable by the city council, bicycle facilities, including bicycle paths and lanes, within the city. There shall be no proration of fees regardless of when the license is purchased during the registration year.

The police department shall keep a record of the date of issue of each bicycle license, the license number of each such license, the serial number of the bicycle to which each such license applies, the make and type of each such bicycle, and the name and address of each licensee. Such records as are herein described shall be maintained by the police department during the period of validity of the license, or until notification is made to the police department that the bicycle is no longer to be operated.

It shall be the duty of the purchaser of a bicycle which has not been previously registered to apply for a new license therefor within ten days of the sale or transfer of ownership.

In registering bicycles, the police department shall utilize the license indicia and registration card provided by the California Department of Motor Vehicles for such purpose. The license indicia shall be attached to the bicycle in such manner as is required by the California Department of Motor Vehicles.
If any license plate or registration card is lost, it shall be the duty of the registered owner of the bicycle to procure a replacement for such license or card, the cost of which replacement shall be one dollar. The replacement of a lost license or registration charge shall not serve to extend or otherwise modify the registration period then in existence with respect to such registration.

All persons engaged in the business of dealing in secondhand bicycles, as such business is contemplated by Section 39006(b) of the California Vehicle Code, are required to keep daily records and make monthly reports to the police department. Such reports shall give the name and address of the person from whom each bicycle is purchased, the description of each such bicycle purchased, the frame number thereof and the number of the license plate found thereon, if any.

Each bicycle retailer and each bicycle dealer shall supply each purchaser of a bicycle with a preregistration form and with such other information as is required by Section 39006 of the California Vehicle Code.

It shall be the duty of every person who sells or otherwise transfers ownership of any previously registered bicycle to endorse upon the registration certificate of such bicycle a written transfer of same, setting forth the name, address and telephone number of the transferee, date of transfer, and signature of the transferor. It shall be the further duty of each such transferor to return the registration certificate, so endorsed, to the police department within ten days of the date of such sale or transfer.
Any person who purchases or otherwise acquires possession of a previously registered bicycle shall, within ten days of taking possession thereof, apply to the police department for the transfer of the license and registration to the transferee's own name. The fee for such transfer shall be one dollar. Such transfer of registration shall in no way extend or otherwise modify the registration period then in existence with respect to such registration.

In addition to such penalties as are established by Section 1.01.110 of this code, the police department or any of the members thereof may impound and retain possession of any bicycle operated within the city in violation of any of the provisions of this chapter, and may retain possession of the same until the license required by this chapter is obtained by the owner of such bicycle.

Bicycle licenses are due and payable in advance on the first day of January of the first year of each three-year registration period beginning January 1, 1979. Each registration renewal shall be for an additional three-year period, and the fee for such renewal shall be three dollars.
