No person shall move any house, building or other structure, or any section or portion of any house, building or structure, without having first obtained from the Street Superintendent a written permit so to do, as provided in this Article.

Applications for permits hereunder must be in writing and be filed with the Street Superintendent at his or her office in City Hall.

Each application for a permit to move a house, building or other structure from outside the City into the City shall contain at least the following information:
(1) 
The address (showing street and number where same exist) of the house, building or other structure proposed to be moved;
(2) 
The address (showing street and number where same exist) to which removal is to be made;
(3) 
The route proposed to be followed in making such removal;
(4) 
The estimated length of time required for traversing public streets or places within the City;
(5) 
The use which has previously been made of the house, building or other structure, and the proposed use thereof after the same shall have been moved to its new location;
(6) 
The dimensions of the house, building or other structure to be moved (length, width and height); the number of stories it contains; whether it is to be moved as a unit or in sections, and if in sections the number thereof and the dimensions (length, width and height) of each;
(7) 
The name and address of the contractor or person who will do the actual work of moving;
(8) 
Four photographs of the house, building or other structure to be moved, which collectively shall show all four elevations thereof;
(9) 
A map or sketch of the property on which the house, building or other structure is to be placed, showing the proposed location on the same thereon, and any other improvements on such property;
(10) 
Plans and specifications for the placement, repair, alteration or improvement of the house, building or other structure in its new location (unless waived as hereinafter provided), and a statement with reference to the nature of the repairs or improvements proposed to be made;
(11) 
A statement that applicant will apply for and obtain any and all permits which may be required in connection with such house, building or other structure under the building, plumbing or electrical codes of the City;
(12) 
A statement that applicant has contacted all public utilities which will be affected by the moving, or moving operations, and has made satisfactory arrangements with such utilities in the event the moving permit required under this Article is granted;
(13) 
An inspection fee as specified in the Master Fee Schedule shall be paid to the Building Division to cover the cost of the preliminary inspection prior to the moving of the building;
(14) 
A cash deposit in an amount to be fixed and determined by the Street Superintendent to guarantee or insure the full and prompt repair of any damage to any public street, or public place or property caused by or resulting from the moving, moving operations, or work. Such deposit shall be held by the Street Superintendent and if the moving is completed without such damage the said deposit shall be returned to the depositor. In the event of damage, however, the Street Superintendent shall cause such damage to be repaired and paid for out of such deposit, returning the balance, if any, to the depositor.

(1) 
On Public Streets. Each application for a permit to move a house, building or other structure from one location within the City to another location within the City, which will require the traversing of any public street or other public place or property, shall show or be accompanied by all of the statements, data, etc. required in Section 11-36 above, excepting only the photographs referred to in subparagraph 8 thereof.
(2) 
Not on Public Streets. Each application for a permit to move a house, building or other structure from one location within the City, to another location within the City, which will not require the traversing of any public street or other public place or property, shall show or be accompanied by all of the statements, data, etc., required in Section 11-36 excepting only those required under subsections 5, 8, 9 and 10 thereof.

Each application for a permit to move a house, building or other structure from a location within the City to a location outside of the City, and which will require the traversing of any public street or other public place or property, shall show or be accompanied by all of the statements, data, etc., required in Section 11-36 excepting only that required under subsections 5, 8, 9, 10 and 11 thereof.

Whenever any application for a permit is filed with the Street Superintendent in accordance with the provisions of this Article, the Street Superintendent shall promptly notify the Building Inspector of the fact of such filing, and it shall thereupon be the duty of the Building Inspector to inspect the house, building or other structure proposed to be moved, and to promptly report to the Street Superintendent in writing his or her findings and recommendations with reference thereto. Said Building Inspector may waive or require the filing of the plans and specifications referred to under Section 11-36, subsection 10, in his or her discretion.

(1) 
Upon receipt of the report and recommendation of the Building Inspector, the Street Superintendent may issue or deny, in his or her discretion, the permit applied for subject to the right of the applicant to appeal to the City Council from any decision made by the Street Superintendent, the right of final determination in case of such appeal being hereby reserved by the City Council.
(2) 
The Street Superintendent may impose such terms and conditions in any permit granted by him or her hereunder as in his or her opinion may be necessary or advisable in connection with the issuance of such permit, or the use thereof, by the permittee, or the moving of the house, building or structure referred to, or which is in any manner related thereto, subject to the right of appeal to the City Council as hereinabove stated.

(1) 
No relocation permit shall be issued unless the applicant therefor shall first post with the Street Superintendent a bond executed by the owner of the premises where the structure is to be located, as principal, and by a surety company authorized to do business in this State, as surety.
(2) 
The bond, which shall be, in form, joint and several, shall name the City as obligee and shall be in an amount equal to the cost, plus fifty percent of the work required to be done in order to comply with all the conditions of such relocation permit as estimated by an architect or engineer, registered by the State of California, employed by the applicant; the amount of said bond to be approved by the Building Official. In lieu of a surety bond, the applicant may post a bond executed by the said owner, as principal, and which is secured by a deposit of cash in the amount named above and conditioned as required in the case of a surety bond; such a bond as so secured is hereinafter called a "cash bond" for the purposes of this Article.
(3) 
Every bond presented pursuant to this Article shall be conditioned as follows:
(a) 
That each and all of the terms and conditions of the Relocation Permit shall be complied with to the satisfaction of the Building Official and the Street Superintendent;
(b) 
That all of the work required to be done pursuant to the conditions of the Relocation Permit shall be fully performed and completed within a time limit specified in the Relocation Permit; or, if no time limit is specified, within ninety days after the date of the issuance by the Street Superintendent of the Relocation Permit. The time limit herein specified, or the time limit specified in any permit, may be extended for good and sufficient cause by the Building Official. No such extension of time shall be valid unless written, and no such extension shall release any surety upon any bond.

(1) 
In those cases where the Street Superintendent deems such inspection necessary, he or she may require a City inspector to be present at or during all, or part, of the actual moving, or moving operations, and the compensation of such inspector must be paid by the permittee and a deposit made by permittee in amount sufficient, in the opinion of the Street Superintendent, to cover such compensation. The compensation of such inspector, however, shall not exceed the sum as specified in the Master Fee Schedule.
(2) 
The inspector shall be designated by the Street Superintendent, and when so designated and acting it shall be unlawful for the permittee, or for any person actually conducting or prosecuting, or engaged in, the moving, or moving operations, to fail, refuse or neglect to comply with the reasonable orders or directions of such inspector, or to stop or suspend moving operations or the work of moving if ordered by the inspector or Street Superintendent so to do.

No person moving any building or structure, or section or portion thereof, over, upon, along or across any public street within the City, shall fail, neglect or refuse to keep a red light burning at all times between sunset and sunrise at each corner of such building or structure, or section or portion thereof, and at the end of any projection thereon while the same or any part thereof is located on or upon any public street.

No person shall after accepting any permit issued under the provisions of this Article fail, refuse or neglect to comply with each and every term and condition under or pursuant to which such permit may have been issued.

Nothing in this Article shall be construed as waiving any requirement or fee which may be set forth or prescribed in connection with any house, building or structure under the provisions of the building, plumbing, mechanical, or electrical codes of the City.
