A. 
This chapter is enacted pursuant to the authority under the Constitution and laws of the State of California, including, but not limited to, California Constitution Article XI, Sections 3 and 5 and Section 935 of the California Government Code; and
B. 
The City of Huntington Beach (the "City") is a municipal corporation and charter City duly organized and existing under a charter pursuant to which the City has the right and power to make and enforce all laws and regulations in respect to municipal affairs and certain other matters in accordance with and as more particularly provided in Sections 3, 5 and 7 of Article XI of the Constitution of the State of California and Section 500 of Article V of the Charter of the City; and
C. 
The City Council of the City acting under and pursuant to the powers reserved to the City under Sections 3, 5 and 7 of Article XI of the Constitution of the State of California and Section 500 of Article V of the Charter of the City, finds that claims filed against the City are a municipal affair and therefore public interest and necessity require the establishment of a process for handling such claims.

All claims against the City of Huntington Beach for money or damages not otherwise governed by the Tort Claims Act, California Government Code Sections 900 et seq., or another state law or another provision of this Code (hereinafter in this chapter, "claims") shall be presented within the time, and in the manner prescribed by Part 3 of Division 3.6 of Title 1 of the California Government Code (commencing with Section 900 thereof) for the claims to which that part applies by its own terms, as those provisions now exist or shall hereafter be amended, and as further provided by this chapter.

All claims shall be made in writing and verified by the claimant or by his or her guardian, conservator, executor or administrator. In addition, all claims shall contain the information required by Government Code Section 910. The foregoing reference to Government Code Section 910 shall not be construed to authorize a class claim or a representative claim, and no claim may be filed on behalf of another person or a class of persons unless verified by such other person(s) and each member of any purported class.

In accordance with California Government Code Sections 935(b) and 945.6, all claims shall be presented as provided in this chapter and acted upon by the City Risk Manager prior to the filing of any action on such claims and no such action may be maintained by a person who has not complied with the requirements of this chapter. Where the amount of the claim exceeds $15,000.00, but is less than $50,000.00, approval of the City Attorney is also required to pay the claim. No claim in excess of $50,000.00 may be paid without City Council approval.

Any action brought against the City of Huntington Beach upon any claim or demand shall conform to the requirements of Sections 940-949 of the California Government Code. Any action brought against any employee of the City of Huntington Beach shall conform with the requirements of Sections 950-951 of the California Government Code.

Should any provision of this chapter, or its application to any person or circumstance, be determined by a court of competent jurisdiction to be unlawful, unenforceable or otherwise void, that determination shall have no effect on any other provision of this chapter or the application of this chapter to any other person or circumstance and, to that end, the provisions hereof are severable.
