As used in this title, the words and phrases defined in this section have the meanings ascribed to them, unless the context otherwise requires. When not inconsistent with the context, words used in the present tense include the future; words in the singular include the plural; words in the plural include the singular; and the masculine includes the feminine.
"Accessory building"
means a detached subordinate building, the use of which is customarily incidental to that of the main building allowed in the zone. Accessory building may be constructed prior to construction of the main building, provided that the construction of the accessory structure shall be in such a size and location on the lot that it shall allow a sufficient area of space for construction of the main building in accordance with the minimum requirements in the applicable zone.
"Accessory use"
means a use naturally and normally incidental to, subordinate to and devoted exclusively to the main use of the premises.
"Alley"
means a public thoroughfare, not exceeding 20 feet in width which affords only a secondary means of access to abutting property.
"Basement"
means a story partly or wholly below the ground level upon which another story is intended to be built.
"Bed and breakfast inn"
means an owner-occupied dwelling unit or portion thereof, where short-term (not more than five consecutive nights) lodging rooms and meals are provided for compensation.
"Building"
means any structure built for the shelter or enclosure of persons, animals, chattels or property of any kind, and not including advertising signboards or fences.
"Building line"
means the main line of the furthest projection of a wall of a building.
"Building official"
means the officer or other designated authority charged with the administration and enforcement of this code, or duly authorized representative.
"Call center"
means a business whose sole operation and activity consists of personnel engaged in placing or receiving phone calls or electronic messages for solicitation of services or merchandise.
"Carport"
means a roofed structure without continuous walls which provides space for the parking or storage of one or more motor vehicles.
"Clinic"
means a building or portion thereof used for the business of admitting patients for study and treatment by licensed physicians, dentists, optometrists, chiropractors and other health care providers.
"Community garage"
means a building, or portion thereof, consisting of a series of stalls under a continuous roof for storing self-propelled vehicles for compensation and located on a lot which contains a minimum of 1,000 square feet for each vehicle stored.
"Compensation"
means and includes payment of money, and payment in kind with services or other things of value.
"Corner lot"
means a lot situated at the junction of two or more streets.
"Day care"
means a building, or portion thereof, used for the business of providing supervised care of children or adults for periods not exceeding 15 hours per day.
"Developer"
means the person, company, or entity that changes improved or unimproved real estate, including buildings or other structures, mining, dredging, filing, grading, paving, excavating, and drilling.
"Dwelling"
means any building or portion thereof which is used as the private residence or sleeping place of one or more human beings, but not including hotels, motels, tourist courts, resort cabins, clubs, hospitals or similar uses.
"Family"
means a group of persons not necessarily related by blood, marriage, adoption or guardianship, living together in a dwelling unit as a single living unit under a common housekeeping management plan based on an intentionally structured relationship providing organization and stability.
"Farmers' market"
means an open style market or gathering for the sale of agricultural, food, or floral products.
"Flea market"
means a market, indoors or outdoors, where new or used items are sold from individual locations, which each location being operated independently from the other locations.
"Floor area"
means the sum of the gross horizontal areas of the several stories of the building measured from the exterior faces of the exterior walls or from the center line of party walls. "Floor area" includes any basement floor, interior balconies and mezzanines, elevator shafts and stair wells, and enclosed porches.
"Frontage"
means that portion of a lot abutting the street right-of-way, measured along the right-of-way line.
"Front lot line"
means the property line dividing a lot from a street. On a corner lot only one street line shall be considered as the front lot line.
"Front yard"
means a yard extending across the full width of a lot between the front lot line and the nearest building line of any building situated on the lot.
"Grade"
means the elevation established by the city measured at the top of the street curb line abutting the property, or if there be no such curb, then at the top of the edge of the roadway abutting the property.
"Height of building"
means the vertical distance from grade to the highest point of the surface of the roof.
"Hospital"
means any building or portion thereof used for the accommodation and medical care of sick, injured or infirm persons and including sanitariums, but not including clinics, rest homes, convalescent homes, congregated housing or assisted living facilities.
"Hotels and motels"
means a building or portion thereof containing 10 or more guest rooms used, designed to be used, let or hired out for occupancy by persons on a more or less temporary basis.
"HUD manufactured home standards"
means the standards published by the United States Department of Housing and Urban Development relating to the construction of manufactured housing, and set forth at 24 C.F.R., Part 3280, Manufactured Home Construction and Safety Standards, as found in Title 15, Chapter 15.04.
"Interior lot"
means a lot other than a corner lot.
"Light manufacturing"
means a business where all processing, fabricating, assembling, or disassembling of items takes place wholly within an enclosed building. Items may include, but are not limited to, apparel, home accessories, food, clothing accessories, decorations, jewelry, instruments, computers, electronic devices, additive manufacturing, light robotics, and component parts.
"Livestock unit"
means one horse, one cow, one sheep, one goat, one mule, one donkey, or one llama, and includes the offspring of any particular livestock unit until such offspring reaches seven months of age. "Livestock unit" does not include swine or fowl.
"Living unit"
means a dwelling unit in which the persons living there share common use and access to all living and eating areas, bathrooms, and food preparation and serving areas.
"Lot"
means a parcel of land occupied or to be occupied by a building or group of buildings and any accessory buildings identified with each, together with such open areas, if any, as are required by the provisions of this title, and having its principal frontage on a public way.
"Lot area"
means the total area within the property lines of the lot, excluding adjacent streets.
"Lot lines"
means the lines bounding a lot as defined in this section.
"Lot width"
means the distance parallel to the front lot line measured between side lot lines through that part of the building or structure where the lot is narrowest.
"Main building"
means a building in which is conducted the main or principal use of the lot on which the building is situated.
"Manufactured home"
means a structure designed for use as a dwelling (including HUD compliant structures) transportable in one or more sections, which:
1. 
In the traveling mode, is eight body feet or more in width or 40 body feet or more in length; or
2. 
When erected on-site, is not less than 320 square feet, and is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to utilities.
"Membership club"
means a group of persons in association with a national organization whether incorporated or unincorporated for some common purpose, but not including groups organized primarily to render a service carried on as a business. "Mobile home" means a manufactured home constructed prior to June 15, 1976, travel trailers, and other similar vehicles that are designed to be towed to a permanent or semi-permanent location, have the axles and wheels as a part of the chassis, and be used as a dwelling without a permanent foundation when connected to utilities.
"Modular home"
means a manufactured/factory built home designed for use as a dwelling, transportable by a temporary chassis, that has:
1. 
Its weight supported, in whole or in part, around the perimeter on a permanent engineered foundation;
2. 
Meets International Residential Code requirements.
"Multiple-family dwelling"
means a building occupied by two or more families living independently of each other, but not including hotels or motels.
"Nonconforming building"
means a building or structure, or portion thereof, built in conformance with applicable city ordinances prior to the effective date of the ordinance codified in this title, or any amendment thereto, and conflicting with the provisions of this title applicable to the zone in which it is situated.
"Nonconforming use"
means the use of a structure or premises which began in conformance with applicable city ordinances prior to the effective date of the ordinance codified in this chapter, or any amendment thereto, and conflicting with the provisions of this title applicable to the zone in which it is situated.
"Nursery"
means a building, premises or any combination thereof, used for the cultivation, storage or sale of live trees, shrubs or plants, including products used for gardening or landscaping. "Nursery" does not include a building, premises, or any combination thereof, used for the sale of edible fruits or vegetable products.
"Occupied"
includes arranged, designed, built, altered, converted, rented or leased or intended to be occupied.
"One-family dwelling"
means a building designed exclusively for, and occupied by, one family.
"Open parking garage"
means a Type I or Type II construction open on two or more sides. Use is exclusively for parking or storage of vehicles. A side is considered open when the total area of the distributed openings are not less than 50% of the exterior projected area. An engineered or standard approved foundation design is required. It is required to meet or exceed wind and snow loading per local design criteria.
"Park"
means city-owned or controlled area of land generally utilized for recreation.
"Permanent building/structure"
means a building or structure that is constructed on a permanent foundation and not on wheels, skids, jacks, or other means of temporary support.
"Private garage"
means a building or portion thereof used for storing self-propelled vehicles, not for compensation.
"Rear lot line"
means the line opposite the front lot line.
"Rear yard"
means a yard extending across the full width of a lot and situated between the rear lot line and the nearest building line of any building on the lot.
"Retail sales"
means sale of services or merchandise where a sales tax is collected at point of sale.
"Shipping container"
means a metal fabricated reusable box designed for shipping merchandise by rail, truck, or vessel.
"Side lot line"
means any lot line other than front lot line or rear lot line.
"Side street"
means the street beside and running lengthwise with the lots in a block, as such lots are platted on the official map of the city, in current use.
"Side yard"
means a yard situated between the side line of the building and the adjacent side lot line and extending from the rear line of the front yard to the front line of the rear yard. If a lot has no front yard, the front boundary of the side yard shall be the street. If a lot has no rear yard, the rear boundary of the side yard shall be the rear line of the lot.
"Small animal"
means a dog, cat, or any other animal that weighs 100 pounds or less and such animal is not referenced in the definition of livestock.
"Soil/water laboratory"
means a place of business where soil and/or water samples are received and processed for scientific analysis.
"Solar collector"
means a device or piece of equipment that directly transforms direct solar energy into thermal, chemical, or electrical energy.
"Solar energy system"
means a complete design or assembly consisting of a solar collector, and energy storage facility (where used), and components for the distribution of transformed energy (to the extent they cannot be used jointly with a conventional energy system).
"Solar sky space"
means the space between the solar energy collector and the sun with such space being free of obstructions that shade the collector to an extent that precludes its cost effective operation.
"Stick built home" or "site built home"
means a structure designed for use as a dwelling that is constructed and assembled from individual components, including structural insulated panels (SIPs), on site and on a permanent engineered foundation.
"Storage units"
means a structure, or series of structures, that is primarily utilized for only the storage of dry goods and materials for other than the owner of said unit(s).
"Street"
means any public or private thoroughfare which affords the principal means of access to abutting property and includes such terms as "public right-of-way," "highway," "road" and "avenue."
"Structural alteration"
means any change in the supporting members of a building, such as bearing walls, columns, beams or girders.
"Structure"
means anything constructed or erected, which requires location on the property or which is attached to something having a location on the property.
"Temporary storage"
means less than 30 days duration in any one calendar year.
"Through lot"
means an interior lot having frontage upon two parallel or nearly parallel streets.
"Transient vendor"
means a merchant who does not have a permanent building at point of sale to conduct their business and/or remains at one place for temporary periods only—generally six weeks or less.
"Travel trailer"
means any of the following:
1. 
"Travel trailer"
means a vehicular, portable structure built on a chassis designed to be used as a temporary dwelling for travel, recreational and vacation uses, permanently identified as such by the manufacturer of the vehicle.
2. 
"Pick-up coach"
means a structure designed to be mounted on a truck for use as a temporary dwelling for travel, recreation and vacation.
3. 
"Motor home"
means a portable, temporary dwelling to be used for travel, recreation and vacation, constructed as an integral part of a self-propelled vehicle.
4. 
"Camping trailer"
means a portable, folding or collapsible structure, mounted on wheels and designed for travel, recreation and vacation use.
"Travel trailer park"
means a parcel of land in which one or more spaces are occupied or intended for occupancy by travel trailers for transient dwelling purposes.
"Use"
means the purpose for which land or building is designed, arranged or intended, or for which either is or may be occupied or maintained.
"Vacant lot"
means a lot devoid of a permanent structure.
"Wholesale sales"
means sale of services or merchandise where a sales tax is not collected at point of sale.
"Yard"
means an open space other than a court, on a lot unoccupied and unobstructed from the ground upward, except as may otherwise be provided for in this title.
