Within the boundary lines of any of the parks defined in section
8-1-1 of this chapter, it is unlawful for any person or persons to do any of the following acts:
A. Damage or Nuisance Acts.
1. To dump or deposit any trash, refuse, rubbish, litter or other kind of waste materials, except in approved containers specifically placed and designated to receive such waste materials;
2. To commit any act of vandalism, including the damaging or destroying of trees or their leaves, limbs or branches, bushes, shrubbery, equipment, signs, trash cans, benches, buildings or rooms, or to tear down or deface the same, or to pick any crops, fruit or flowers in any portion of such public park;
3. To cut and remove any wood or to remove turf, grass, soil, rock, sand, gravel or fertilizer.
B. Firearms, Etc. To bring or use any firearms or air or gas or spring propelled guns, slingshots, bows and arrows, javelins, discus, golf clubs and golf balls, or any similar projectile or projectile throwing device, except that such may be permitted in such portions of public parks as are specifically determined to be safe for such uses and are so designated by the city manager.
C. Fires. To start or maintain any fire, except in such areas as are specifically designated for such fires (including, but not limited to, stoves, barbecue pits and fire rings) as approved by the city manager and fire chief.
D. Fireworks.
1. To discharge or set off any firecrackers, torpedoes, rockets or other fireworks except where a permit has been granted by the city manager;
2. The city manager shall grant such permit only where he or she finds that it is for an established civic celebration, the person proposing to discharge or set off said fireworks has the necessary skill and experience to do so, and that it can be done without endangering persons or property.
E. Acts Relating to Animals.
1. To stable, pasture or keep animals or insects except with permission of the city council;
2. To let loose any animal or fowl of any kind. No person owning or having custody or control of any dog shall knowingly or through failure to exercise due care or control, permit such dog to defecate in any public park, school ground or other public place, including the sidewalk or parkway of any street, or upon any private property, without the consent of the owner or lawful occupant thereof. A person shall not be considered in violation of this subsection if the person has necessary equipment, e.g., shovel, bag, etc., readily available and does take immediate and necessary action to accomplish removal of fecal matter left by the dog. Exception: dogs which have been specially trained and are being used by blind or disabled persons to aid and guide them in their movements.
F. Enter on Prohibited Areas. To enter any portion of a public park in the city, or buildings or portions thereof in such public parks and which are posted with signs stating "No Entry," "Keep Out," "No Trespassing," "Closed Area," or other prohibition of entry.
G. Closing Hours. To enter any portion of or be in a public park in the city at a time of the day, or on a day of the week, when such entry is prohibited by a clearly legible sign posted at each entrance to such public park. The city manager is given authority to post such signs.
H. Acts Relating to Vehicles.
1. To park any automobiles or any other vehicles in any public park in the city, except in areas specifically designated as parking areas by the city manager.
2. To use or operate any motor powered vehicles, other than motor vehicles as defined in the
Vehicle Code at any time, except as permitted by the city manager in designated streets or parking areas or as part of a supervised recreational activity. This subsection does not apply to officers, agents or employees of the United States, the state, the city or other local governmental agency, when they are using motor powered vehicles in the performance of their official duty, nor to the use of motor powered vehicles in emergencies when it is necessary to use them for the preservation or protection of life or property, nor to utility companies using motor powered vehicles for the installation, maintenance, repair or servicing of utility lines when permission is obtained from the city manager.
I. Structures or Appurtenances—Construction of. To construct or erect on any portion of a public park in the city any building, fence or structure of whatever kind, whether permanent or temporary in character, or run, or string or install any public service utility into, upon or across such lands, except on special written permit of the city manager. Each day such condition exists shall constitute a new and separate offense.
J. Camping. To camp or lodge therein except on special written permit of the city manager.
K. Sports. To play or engage in any sport or sporting event in any picnic area.
L. Gatherings.
1. To disturb in any manner any picnic, meeting, service, concert, exercise or exhibition.
2. For any persons to assemble, collect or gather together in any walk, passageway or pathway set apart for the travel of persons through any park or to occupy same so that the free passage or use thereof by persons passing along the same shall be obstructed in any manner.
M. Loudspeakers, Etc. To use or permit to be used any public address system, loudspeaker, bullhorn or other power amplified sound equipment without first obtaining a written permit from the city manager.
N. Handbills. To distribute any handbills or circulars or to post, place or erect any bills, notice, paper or advertising device or matter of any kind.
O. Merchandise and Commercial Enterprises.
1. To sell or offer for sale or to rent or lease any merchandise, article or thing, whatsoever, unless granted a valid written permit by the city manager.
2. To practice, carry on, conduct or solicit for any trade, occupation, business or profession of whatsoever kind or character without written permission of the city manager.
3. To engage in any sidewalk vending activity without a valid sidewalk vendor permit or in a manner inconsistent with title
4, chapter
4 of this code in any public park or along any public street or thoroughfare adjoining or approaching any public park in the city. This paragraph does not apply to businesses on private property that are adjacent to parks.
P. Use of Restrooms. No person who is over eight years of age shall enter or use any water closet, restroom, dressing room or other facility in a public park designated for exclusive use by persons of the opposite sex.
Q. Operation of Vehicles and Bicycles. No person shall use, drive or otherwise operate a vehicle in a city park, and no person shall ride a bicycle (as defined in the
California Vehicle Code) in a city park upon surfaces other than those maintained and open to the use of the public for purposes of vehicular travel except upon written permission of the city manager.
R. Alcohol Consumption. No person shall consume an alcoholic beverage, or have in his or her possession any receptacle containing any alcoholic beverage which has been opened, or a seal broken or the contents of which have been partially removed in any public area or park except.
1. In Hans Christian Andersen Park, but then only in the improved, permanent picnic and barbecue areas and/or by permit only, in the Atterdag Bowl.
2. In Sunny Fields Park, but then only in the improved, permanent picnic and barbecue area.
3. In Solvang Park where written permission for a special event has been obtained from the city manager at least 24 hours prior to such act.
Individuals, businesses, or organizations engaging in the sale of alcoholic beverages shall be properly licensed by the state department of alcohol beverage control. |
