The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Brush
means cuttings or trimmings from trees, shrubs, or similar materials which are not susceptible to placement in disposable containers.
Commercial
refers to a business enterprise or other nonresidential activity.
Commercial use
means a person hauling and disposing brush, debris, garbage, and trash at the Jefferson-Marion County Solid Waste Site for a fee or remuneration paid by another person; provided such brush, debris, garbage, and trash is deposited in a vehicle and/or trailer that does not exceed one ton in weight.
Debris
means dirt, concrete, rocks, bricks, or other waste building materials.
Dry kitchen refuse
means the solids after the liquid or slop has been drained off.
Garbage
means items including, but not limited to, used and/or discarded food waste or refuse.
Industrial use
means residential use or commercial use as defined in this section; however, such brush, debris, garbage, or trash shall be deposited at the Jefferson-Marion County Solid Waste Site in a vehicle and/or trailer that is one ton or greater in weight.
Kitchen garbage
means dry kitchen refuse, all meat, vegetable and fruit refuse, small dead animals and dead fowls, from any premises within the city limits.
Premises
includes, but is not limited to, business houses, residences, offices, theaters, hotels, restaurants, hospitals, medical clinics, schools, nursing homes, retail establishments, nurseries, charitable and religious institutions, gas stations, manufacturing and processing plants, all other such grounds upon which the same are located, tracts of land, vacant lots, and all other places where garbage, trash, rubbish and/or waste accumulate.
Primary structure
means the largest or most physically dominant improvement on real property.
Resident
means all individuals who are residents of, own real property in, or have the principal office of their principal places of business located in the county, and all partnerships, corporations, associations, firms, or other business entities who own real property or have the principal office of their principal place of business located in the county.
Residential
refers to buildings, or rooms fitted or used, in part or in whole, for private human sleeping accommodations and household activities including, but not limited to, individual residential houses, manufactured homes, garage apartments, and multifamily housing.
Residential use
refers to use of the Jefferson-Marion County Solid Waste Site to dispose of brush, debris, garbage, and trash from an individual's principal place of residence or principal business; provided, such brush, debris, garbage, and trash is disposed of in a vehicle and/or trailer which does not exceed one ton in weight.
Rubbish
means items including, but not limited to, tin and/or aluminum cans, paper, empty bottles or glass containers, fragmented glass, scraps of iron or other metal, wire, plastic articles, empty boxes, and other such waste product items of normal household activity.
Sanitation container
means wood, metal, or plastic dumpsters, boxes or containers, fixed with a lid or other opening, which has as its primary purpose the temporary storage of waste.
Trash
means items including, but not limited to, used rubber articles, pieces of wood, rope, empty boxes, sheetrock, weeds, grass, tree limbs, lawn and shrub trimmings, insulation, pipe, and any items associated with building construction.

Any person, partnership, corporation, association, firm, or other entity, or any of their respective agents, servants, officers, employees, subscribers, or assigns, violating any of the provisions of this chapter shall, upon conviction thereof, be punished as provided for in section 1-15 of this Code. This chapter shall be enforceable by specific performance, injunction, and any and all other remedies allowed by law.

The city, in the interest of protecting the health and safety of its citizens, shall have the duty to monitor the disposal of garbage, trash, and rubbish within the city limits, and oversee proper enforcement of this chapter.
