The city council has designated and may in the future so designate some area or areas, for the purpose of discharging, disposing of, or dumping trash, refuse, garbage and/or debris, which area or areas shall be known as the official city solid waste disposal site. When such area has been so designated it shall be recorded in the minutes of the city council.

The city is the owner of that certain lot, tract, or parcel of land described in Exhibit "A," on file in the office of the city secretary, and incorporated in this article by this reference, near Highway 134 southeast of the city limits. Such property shall hereinafter be referred to as the "Jefferson-Marion County Solid Waste Site."

The city council shall maintain and operate the city solid waste disposal site through such agents, contractors and representatives or servants as it desires and shall designate one of such persons as the superintendent of the city solid waste disposal site. The city council shall have the power and duty to:
(1) 
Regulate the use of such grounds and the placing of trash and debris on such grounds, including the hours during which such grounds may be used for such purposes;
(2) 
The places where debris may be deposited;
(3) 
The restriction or regulation of other activities on such premises;
(4) 
The restriction and the regulation of the type of garbage and refuse which may be deposited therein, including the hours during which such grounds may be used for such purposes;
(5) 
The places where debris may be deposited;
(6) 
The restriction or regulation of the types of garbage and refuse which may enter therein; and
(7) 
Make other incidental rules and regulations which may be necessary or advisable in the enforcement of this article and in the use and maintenance of such solid waste disposal site.

The city council shall have the power to alter, adjust or repeal any of the restrictions and regulations governing the use of such city solid waste disposal site at any time and from time to time, without advance notice, provided that no person shall be convicted of violation of such restrictions and regulations unless such person had a reasonable opportunity to know of such regulations and restrictions.

The restrictions and regulations prescribed by the city council for the use of the city dumping grounds shall be posted by appropriate signs or notices placed near the premises. It shall be unlawful for any person or group of persons to violate or refuse to follow such restrictions and regulations or to deface, remove or damage any of the notices placed pertaining to such restrictions and regulations.

It shall be unlawful for any person, firm or corporation to discharge, dispose of, or dump any trash, refuse, garbage and/or debris at any place within the city, other than within the official city solid waste disposal site.

It shall be unlawful for any person, partnership, corporation, association, firm, or other entity or any of their respective agents, servants, officers, employees, subscribers, or assigns to deposit any other matter at the Jefferson-Marion County Solid Waste Site other than brush, debris, garbage, and trash or to deposit any steel metal bands or tires at the Jefferson-Marion County Solid Waste Site.

Notwithstanding any provision in this article to the contrary, no hazardous waste, radioactive waste, or class I industrial solid waste, as those terms are defined in the municipal solid waste management regulations by the state natural resource conservation commission, shall be accepted for disposal or deposited at the Jefferson-Marion County Solid Waste Site.

It shall be unlawful for any resident of the city or their respective agents, servants, officers, employees, subscribers, or assigns to deposit or cause to be deposited any brush, debris, garbage, and trash at the Jefferson-Marion County Solid Waste Site without first obtaining a permit from the city. The provisions of this section shall not apply to any duly authorized agents or employees of the city, and persons acting pursuant to a contract with the city for public collection and disposal of brush, debris, garbage and trash. It shall be unlawful for any person or other entity who is not a resident of the city to deposit or cause to be deposited any brush, debris, garbage, trash or other matter at the Jefferson-Marion County Solid Waste Site.

(a) 
Application.
The application for a permit as required in this article shall set forth the name and address of the applicant, the basis upon which such person qualifies as a resident, the trade name under which the applicant does or proposes to do business, the number of vehicles the applicant desires to operate, the size, class, license plate number and design of each vehicle, and such other information as the city council may require.
(b) 
Fees.
The annual permit fee for a resident engaging in residential use of the Jefferson-Marion County Solid Waste Site shall be a one time fee in the sum of $5.00, for a resident engaging in commercial use of the Jefferson-Marion County Solid Waste Site shall be $10.00 per month, and for a resident engaging in industrial use of the Jefferson-Marion County Solid Waste Site shall be the sum of $20.00 per month.

In all cases where a permit has been issued for the disposal of brush, debris, garbage, and trash, such permit shall be in the possession of the person rendering such service and shall be subject to inspection at all times; and, if such permit is not in the possession of such person, such person will not be allowed to dispose of such brush, debris, garbage, and trash at the Jefferson-Marion County Solid Waste Site.
