For the protection and preservation of the health, safety, property and the general welfare of the people of the city, the city now adopts Texas Occupations Code, title 8, Regulation of Environmental and Industrial Trades, chapter 1302, Air Conditioning and Refrigeration Contractors, as amended from time-to-time, cited as the "Texas Air Conditioning and Refrigeration Contractor License Law," in its entirety as its own. All air conditioning, heating, and refrigeration work done in the city must be done in accordance with the Texas Air Conditioning and Refrigeration Contractor License Law.

A certain document, one copy of which is on file in the office of the city manager, being marked and designated as the "International Mechanical Code," 2021 edition, including appendix A of the "International Mechanical Code," published by the International Code Council, is now adopted as the mechanical code for the city for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of heating, ventilating, cooling, refrigeration systems, incinerators or other miscellaneous heat-producing appliances in the city, and the issuance of permits and collection of fees. Each and all regulations, provisions, conditions, and terms of such "International Mechanical Code," 2021 edition, published by the International Code Council, on file in the office of the city manager are now referred to, adopted and made a part of this section as if fully set out in this division.

(a) 
Position of mechanical inspector.
The city manager shall appoint the mechanical inspector and any assistants necessary to aid him in the discharge of his duties.
(b) 
Qualifications of mechanical inspector.
The mechanical inspector shall have a minimum of three years' experience in the design, construction, repair, and installation of air conditioning, heating, and refrigeration equipment or be certified by the International Code Council. He shall not have any interest whatsoever, directly or indirectly, in the sale or manufacture of any material, process or device entering into or used in connection with air conditioning, heating, and refrigeration.

The rates and fees schedule is provided by resolution as amended from time-to-time. All fees to be in effect shall be paid at the time a permit is issued.

Whenever in the mechanical code, or in any ordinance of the city amending such code, an act is prohibited, is made or declared to be unlawful, is made an offense, or wherever in such code or ordinance the doing of an act is required or the failure to do any act is declared to be unlawful, and no specific penalty is provided, the violation of any such provision of such code or any such ordinance shall be punishable by a fine not exceeding $1,000.00; provided, however, that no penalty shall be greater or lesser than the penalty provided for the same or similar offense under the laws of the state. Each day any violation of this mechanical code or any ordinance shall continue shall constitute a separate offense.

The city reserves the right at any time to change, amend, alter, repeal, rescind, or add to these rules and regulations, or any part thereof, or to adopt any new rule or regulation or any temporary exception with respect to building or anything pertaining thereto.
