For the purpose of this chapter, the following definitions shall apply:
"Private property police tow"
means any vehicle that is towed under Section 10.54.020 that is found to have been reported stolen, or for any other reason requires a police release.

A. 
Any person towing and/or impounding a vehicle from private property in the City of Milwaukie without consent of the owner of the vehicle shall notify the Milwaukie Police Department prior to towing the vehicle.
B. 
The method of notification shall be a telephone call to the City Police Department prior to attaching any equipment to a vehicle on private property.
C. 
Release of a vehicle designated as a private property police tow is prohibited without a release or other authorization from the appropriate police agency.

Late reporting or failure to report prior to tow will result in the assessment of a penalty. The penalty shall be $500 for each incident. Penalties shall be payable to the City of Milwaukie.
