The city manager shall be appointed by the council on the basis of his or her executive and administrative qualifications and such other qualifications as may be established by the city council. The city manager shall hold office at the pleasure of the council.
No council member shall be eligible for appointment as city manager until one year has elapsed after such council member has ceased to be a member of the council.

The city manager shall be the chief executive of the city government under the direction and control of the council, except as otherwise provided in this chapter. The city manager shall have authority over all other officers and employees of the city except the city treasurer and city attorney.

A. 
The council and its members shall deal with the administrative services of the city through the city manager, except for the purpose of inquiry. Should any council member make an inquiry, it shall be for the purpose of compiling facts and data. The city manager shall take instructions and direction from the council and no individual council member shall give instructions or directions to the city manager or other city employee.
B. 
The city manager shall attend all meetings of the city council unless excused therefrom by the mayor or the council.
C. 
The city manager may take part in council discussions but may not vote. The city manager shall have the authority to appear and address the council or any of its commissions at any meeting.
D. 
The city manager shall recommend to the council for adoption such measures and ordinances as that official deems necessary or desirable. The city manager shall keep the council fully informed at all times as to the financial condition and needs of the city and shall make such reports as may be desirable or as requested by the council.

The city manager shall be responsible for the efficient administration of all the affairs of the city which are under that official's control. In addition to the city manager's general authority as administrative head, and not as a limitation thereof, it shall be the city manager's duty and that official shall have the authority to:
A. 
Enforcement of Laws. See that the laws of the state of California pertaining to the city and all laws and ordinances of the city are duly enforced, and that all franchises, contracts, permits and privileges granted by the city are faithfully observed;
B. 
Appoint, Dismiss, Supervise, etc. Appoint and promote, discipline, suspend, demote, or dismiss, employees of the city except the city attorney and city treasurer;
C. 
Administrative Reorganization of Offices. Conduct studies and effect such administrative reorganization of offices, functions, positions or units under the city manager's direction as may be indicated in the interest of efficient, effective and economical conduct of the city's business;
D. 
Appoint to Acting Capacity. Designate him or herself or some other officer or employee to perform the duties of any office or position in the municipal service under the city manager's control which is vacant or which lacks administration due to the absence or disability of the incumbent;
E. 
Purchases. Purchase or cause to be purchased by some officer designated by the city manager all services, supplies, and equipment for all of the departments of the city. All purchases and expenditures for purchases shall be made in accordance with procedures established by ordinance or resolution;
F. 
Public Property. Exercise general supervision over all public buildings, public parks, streets and other public property which are under the control and jurisdiction of the council;
G. 
Annual Report. The annual report shall be submitted in February of each year, or at such other time as the council may determine;
H. 
Annual Budget and Capital Program. They shall be presented to the council at or before the second council meeting in May of each year, or at such other time as the council may determine;
I. 
Miscellaneous Duties.
1. 
Serve in any appointed office within the city government for which he or she may be qualified when appointed thereto by the council, and to hold and perform duties thereof at the pleasure of the council,
2. 
Investigate all complaints related to matters concerning the administration of the city government and services to its citizens,
3. 
Perform such other duties and exercise such other authorities as may be delegated to him or her from time to time by action of the council.

The city manager shall have the authority to properly perform any duty assigned to that office by the city council or by other process of law. In general, the city manager's authority shall include:
A. 
Prescribe Rules. Have the authority to prescribe such rules and regulations as he or she shall deem necessary for the conduct of administrative agencies subject to the city manager's authority, and he or she shall have the authority to revoke, suspend or amend any rule or regulation of the administrative service by whomever prescribed.
B. 
Investigate. Have the authority, either personally or by any person designated by the city manager, to investigate and examine or inquire into the affairs or operations of any function and any contract, or the proper performance of any obligations of or to the city; and when so authorized by the council, the city manager shall have the authority to employ consultants and professional counsel to aid in such investigations, examinations or inquiries.
C. 
Overrule Officials. Have the authority to set aside any action taken by another employee and to supersede any such employee in the functions of that employee's office.
D. 
Delegate Duties. Have the authority to direct any department to perform the work for any other department.

A. 
Acting City Manager. The assistant city manager shall serve as acting city manager during any temporary absence or disability of the city manager. In the event of the absence or disability of the assistant city manager, the city manager, by filing a written notice with the mayor, shall designate a qualified city employee or officer to exercise the authority and perform the duties of the city manager during a temporary absence or disability of the city manager. In the event of failure to make such designation, the city council may appoint an acting city manager.
B. 
Bond. The city manager and assistant city manager shall be bonded to assure the faithful performance of the duties imposed on them as herein prescribed. Such bond may be part of a blanket surety bond, and the premium for same shall be a proper charge against the city.
C. 
Compensation—Expenses. The city manager shall receive such compensation and benefits as the city council shall from time to time determine.
The city manager shall be reimbursed for all sums necessarily incurred by that official in the performance of his or her duties or incurred while traveling on business pertaining to the city.
D. 
Agreements on Employment. Nothing in this chapter shall be construed as a limitation on the authority of the council to enter into an agreement with the city manager delineating the terms and conditions of employment.
E. 
Assistance From Others. It shall be the duty of all subordinate officers, officials under contract with the city, city commissions, city treasurer and city attorney to assist the city manager in administering the affairs of the city efficiently, economically and harmoniously.
