No person shall offer for sale or sell any fireworks or pyrotechnic device of any kind in the city. This section shall not apply to any person licensed by the state of California to sell fireworks or pyrotechnic devices where the city is not authorized to require an additional permit pursuant to Section 12640 of the Health and Safety Code of the state of California.

No person shall use or discharge any fireworks or pyrotechnic device of any kind in the city, except in conformance with the provisions of Chapter 4.01 of this code, known as the fire code of the city.

The provisions of this chapter shall not apply to toy pistols, toy cranes, toy guns, or other similar devices in which paper caps containing not more than twenty-five hundredths grain of explosive compound per cap are used.

Any person violating any provision of this chapter shall be guilty of a misdemeanor, and upon conviction shall be punishable by a fine of not more than $1,000 or by imprisonment of a period not exceeding six months or both.
