Between the hours of two a.m. and six a.m., it shall be unlawful for any person to park any motor vehicle on any alley, street, public right-of-way, publicly owned and/or operated parking lot, other publicly owned property including, but not limited to, parks, school grounds or open space, or to park on any private parking lot without the expressed permission of the private property owner, for the purpose of sleeping in the motor vehicle.

This chapter shall not apply to:
A. 
Persons who engage in the activity due to medical emergency or need as determined by a responding emergency services provider or as confirmed, in writing, by a licensed physician;
B. 
Persons who are intoxicated or under the influence of alcohol, any controlled substance and/or any chemical condition and/or state of physical condition such that the person must engage in the activity in order to avoid being a threat to his or her own personal safety or the safety of others.

Any person violating any of the provisions of this chapter shall be deemed guilty of an infraction punishable by a fine as follows:
A. 
Fifty dollars for a first violation;
B. 
One hundred dollars for a second violation occurring within a 12 month period following the first violation;
C. 
Two hundred fifty dollars for a third or more violations occurring within a 12 month period following the first violation.
