The purpose of the emergency shelter overlay zone is to achieve the following:
A. 
To provide for areas within the community planned development (CPD) zone where emergency shelters, in accordance with Government Code Section 65583, are allowed without a conditional use permit or other discretionary permit.
B. 
To establish designated boundaries in appropriately located CPD zoned areas to maximize the potential for provision of emergency shelters in the city.
C. 
To permit emergency shelter uses in areas that have a realistic potential for development or reuse opportunities for emergency shelters.

The ESOZ shall apply to several areas of the CPD zone as specified in reference maps adopted with the emergency shelter overlay zone and available in the community development department. All land use regulations and development standards for commercial uses as specified in Chapter 11.14 shall remain in effect. The effect of the emergency shelter overlay zone shall be to define the area of applicability within the CPD zone where emergency shelters shall be permitted with director approval, in compliance with the development standards for emergency shelters as specified in Section 11.18.020.

A. 
Emergency shelters located in the emergency shelter overlay zone shall be developed and operated according to the land use regulations, development standards and design guidelines for the CPD zones, as applicable, as well as Chapter 11.20, and Section 11.18.020.
B. 
Emergency shelters shall be permitted with the approval of an administrative permit within the emergency shelter overlay zone as specified in Table 11.14.020 of Chapter 11.14.
C. 
In accordance with Government Code Section 65583(4), one emergency shelter is permitted by right in the city. Additional emergency shelters beyond those necessary to meet the needs of the city's homeless population, as required by state law, would require a conditional use permit (CUP) in accordance with Section 11.14.020.
