A. 
Every official, officer, employee, and agent of the City who finds any property in or upon any public street, sidewalk, public property, or public building in the City, which property appears to be lost or abandoned, and is of the value of $50.00 or more, shall deliver the property to the Police Department immediately upon finding it.
B. 
Any other person who finds a lost or abandoned item is not bound to take charge of it, but if the person does take charge of it, that person shall, within a reasonable time, inform the owner, if known, and restore the property to the owner. If the owner is unknown or has not claimed the property within a reasonable time, and if the property is of the value of $100.00 or more, the finder shall deliver the property to the Police Department.
C. 
The Police Department shall make provisions for receiving and safekeeping lost property, including money that is found and delivered to it. A police property report shall be made by the person receiving such property. A finder of property delivered to the Police Department shall sign an affidavit stating the following: (1) when and where the property was found; (2) a description of the property; (3) whether the owner of the property is known to the finder; (4) the circumstances of the discovery of the lost items; (5) that the finder has not secreted, withheld, or disposed of any part of the property; and (6) whether the finder seeks to claim the property in the event the true owner does not claim it. The Police Department shall keep a register of lost property which shall contain the police property report, the finder's affidavit, and any other information the Police Chief, or designee, deems relevant.

A. 
Property received pursuant to Section 13.68.010 of this chapter shall be stored by the City in a safe place for a period of three months, unless sooner claimed by the true owner. Any property not claimed by the end of the three-month period shall be deemed unclaimed property and shall be subject to disposal pursuant to this chapter.
B. 
For the purposes of identifying the true owner of the property, identifying and disposing of any dangerous or perishable items, and documenting the contents of any item of property for the protection of the true owner, the Police Department may conduct an inventory search of any property found. To the extent reasonably necessary to fulfill these purposes, the Police Department may open closed containers found within any item of property.

The true owner of lost property may claim the property at any time during the three-month period by providing proof of ownership satisfactory to the Police Chief, or designee. Before releasing the property to the owner, the Police Department may charge the owner for the care of the property and publication, if any, an amount not exceeding 10% of the value of the property. In the event the person seeking to claim the property cannot provide satisfactory proof of ownership, the Police Department may refuse to deliver the property until ordered to do so by a court of competent jurisdiction.

A. 
If the true owner of the property does not claim the property within the three-month period and the reported value of the property is $250.00 or more, at the end of the three-month period, the Police Department shall cause notice to be published at least once in a newspaper of general circulation within the City. Such notice shall provide that the City is in possession of the lost property. If the true owner does not claim the property within seven days following publication of the notice, the person who delivered the property to the Police Department may claim the property if he or she stated a desire to do so in the affidavit required by Section 13.68.010(C) of this chapter. The Police Department may charge the finder for the care of the property, as set forth in Section 13.68.030 of this chapter.
B. 
If the true owner of the property does not claim the property within the three-month period and the reported value of the property is less than $250.00, at the end of the three-month period, the person who delivered the property to the Police Department may claim the property if he or she stated a desire to do so in the affidavit required by Section 13.68.010(C) of this chapter. The Police Department may charge the finder for the care of the property, as set forth in Section 13.68.030 of this chapter.
C. 
Officials, officers, and employees of the City may not claim property pursuant to subsections A and B of this section.
D. 
Notwithstanding subsections A and B of this section, firearms, weapons of any kind, bicycles, and motorized vehicles of any kind shall not be delivered to the finder under any circumstances.

All money delivered to the Police Department pursuant to Sections 13.68.010(A) and (B) of this chapter, and not delivered to the true owner during the three-month period, shall, within 30 days after the end of that period, be deposited into the City's general fund.

A. 
Property received by the Police Department and not delivered to the true owner or the finder shall be disposed of pursuant to this section within 30 days following the end of the three-month period.
B. 
If the Police Chief, or designee, determines that the property is of a kind that may be sold at auction, the property shall be sold to the highest bidder at an auction open to the public unless appropriated for use by the City.
C. 
Any property offered for sale at an auction and not sold, and not suitable for appropriation by the City, shall be deemed to be of no value and shall be disposed of in a manner to be determined by the Police Chief, or designee; provided, however, that no such items shall be given or sold to officials, officers, or employees of the City or their relatives.
D. 
If the Police Chief, or designee, with the consent of the City Manager, determines that the property is needed for a public use, the item may be appropriated by the City. Any items so appropriated shall be delivered to the appropriate City department by the Police Department.
E. 
If the Police Chief, or designee, determines that the property is not of a kind that may reasonably be sold at auction, the Police Chief, or designee, shall make all necessary and appropriate arrangements for the destruction of the property.
F. 
Notwithstanding any other provision of this chapter, any lost or abandoned property in the possession of the Police Department that the Police Chief, or designee, reasonably determines to be dangerous or perishable may be disposed of immediately, without notice, in a manner to be determined by the Police Chief, or designee.
