Any person, firm or corporation, whether as principal, agent, employee or otherwise, violating or wilfully failing to comply with any provision of this code shall be guilty of an infraction for any such violation and shall be subjected to the penalties as provided in Section 1.08.030, unless a different penalty is prescribed or unless the violation is made a misdemeanor.

A. 
Excepting cases where a different penalty is prescribed by any ordinance of the city, any person convicted of a misdemeanor violation of an ordinance of the city is punishable by a fine of not more than one thousand dollars, or by imprisonment not to exceed six months, or by both such fine and imprisonment.
B. 
Violation of the sections of this code listed below may be punished as a misdemeanor punishable by a fine of not more than one thousand dollars or by imprisonment not to exceed six months, or by both such fine and imprisonment; however, any offense that may be cited as a misdemeanor that is not listed in subsection C below may alternatively be punished by a fine as described in Section 1.08.030 when the conditions described in subsection C have been met.

Violation of all of the sections listed in subsection B above, other than Sections 2.44.110, 5.28.140, 5.37.100, 8.70.160, 9.08.030(C) and Chapter 9.09, may be punished by a fine as described in Section 1.08.030 if the responsible party has not previously been convicted of the same or substantially similar code violations or public nuisances within the past five years.

For all misdemeanor violations, a forfeiture of bail shall be equivalent to a conviction. The amount of bail shall be such as the city council may establish by resolution.

Any person convicted of an infraction for violation of an ordinance of the city is punishable by:
A. 
A fine not to exceed one hundred dollars for a first violation;
B. 
A fine not to exceed two hundred dollars for a second violation of the same ordinance within a twelve-month period;
C. 
A fine not to exceed five hundred dollars for a third violation of the same ordinance within a twelve-month period;
D. 
A fourth violation of the same ordinance within a twelve-month period shall be prosecuted as a misde-meanor and subject to the penalties proscribed in Section 1.08.020.

Notwithstanding any other provision of this code, when any minor under the age of eighteen years is charged with a violation of this code, and a peace officer issues a notice to appear in Superior Court to such minor, the charge shall be deemed an infraction unless the minor requests that a petition be filed under a Welfare and Institutions Code 601 or 602, and shall be heard, pursuant to Welfare and Institutions Code 256, by the traffic hearing officer of the Los Angeles County Juvenile Court. The amount of the fine imposed shall be set by such court.

The precise amount of the fine for a specified infraction shall be established by resolution of the city council, but shall not exceed the amounts established in Section 1.08.030.

A person is guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinances of the city is committed, continued or permitted by such person, and he or she shall be punishable accordingly.
