The city council herby finds and declares that posting and distributing
unwanted handbills in the manner prohibited by this chapter constitutes
a nuisance through the defacement of public property and private property
and creation of litter.

As applied in this chapter, the following words and terms shall
be defined as follows:
"Handbill"
means any printed or written matter, poster, lawn sign, sample
circular, leaflet, pamphlet, paper, booklet, printed matter of literature,
flyer or any other similar printed item. For the purpose of this chapter,
the term "handbill" does not mean missing people or lost pet signs.
"Person"
means natural person, firm, partnership, association, corporation,
company, public utility or organization of any kind.
"Public place"
means any street, sidewalk, alley, public way, public park,
public square, public space, public grounds or public building.

Any person violating the provisions of this chapter shall be
subject to penalties in the amount of five hundred dollars for the
first violation, seven hundred fifty dollars for the second violation,
and one thousand dollars for the third violation. Each day a violation
of this chapter exists without correction shall constitute a new and
separate violation punishable as a separate infraction, misdemeanor,
and/or civil violation, as the case may be.

Any violation of this chapter is a misdemeanor and shall be punishable as set forth in Chapter
1.08 of this code. Any person, who may otherwise be charged with a misdemeanor as a result of a violation of this chapter, may be charged, at the discretion of the prosecuting authority, with an infraction.

Any person empowered by the city to issue citations may issue
citations to enforce compliance with this chapter.
