There is hereby established a harbor management commission for the town consisting of seven (7) electors of the town, all appointed to serve overlapping terms and not more than four (4) of whom shall be members of the same political party. The harbor management commission shall have all of the duties set forth in G.S. §§ 22a-113k through 22a-113s.

(a) 
The appointing authority shall be the board of selectmen.
(b) 
The appointing authority shall appoint the following number of members to represent each of the following entities on the harbor management commission:
(1) 
Board of selectmen, two (2);
(2) 
Planning commission, one (1);
(3) 
Shellfish commission, one (1);
(4) 
Westbrook Marina Association, one (1);
(5) 
Westbrook Council of Beaches, one (1);
(6) 
Conservation commission, one (1).
The named entities may recommend electors for such positions to the appointing authority. Such electors may either be members of said entities or electors willing to act as representatives of same.
(c) 
Members of the harbor management commission so designated shall provide information on the activities of the harbor management commission to such entity each such member is designated to represent.
(d) 
The term of office for each member shall be three (3) years from date of appointment or until a successor is appointed.
(e) 
If any member of the commission misses four (4) consecutive meetings, the board of selectmen may remove the member and fill the vacancy in accordance with the provisions of subsection (f) of this section.
(f) 
Vacancies on the harbor management commission shall be filled by the board of selectmen for the balance of the term. The board shall solicit a recommendation from the appropriate entity for such vacancy and appoint an elector to represent said entity.
(g) 
The harbor master shall be a non-voting ex-official member of the commission, in addition the board of selectmen may appoint one (1) or more ex-officio members, who shall have no voting privileges, as follows: A member of the board of selectmen and one (1) or more representatives of Westbrook High School chosen from the junior or senior class.

Upon the expiration of the term of each current member of the harbor management commission, the position shall be filled in accordance with section 8-52 as amended.

The board of selectmen shall appoint two (2) alternate members of the harbor management commission who shall not be members of the same political party. Each alternate shall hold office for the same term and under the same provisions as a regular member of the board and shall serve as designated by the chairman in the absence of a regular member.

In January of each year, the harbor management commission shall elect a chairman, a secretary and such other officers and committees as it may desire from its membership, and may from time to time adopt such rules to govern its operations as it may desire.

(a) 
The harbor management commission shall promote and develop the use of navigable waters of the town and the mooring, docking, landing and other facilities appurtenant to navigation, to the extent of the town's authority therein, and with full regard for the protection, preservation and enhancements of the air, water and other natural resources of the town, and shall perform such other duties, within its scope, as may, from time to time, be delegated to it by the board of selectmen or the town meeting.
(b) 
The following shall be included in the commission's scope of activities:
(1) 
Establish a set of bylaws governing activities of the commission;
(2) 
Maintain and be familiar with a complete and up-to-date file of local, state and federal regulations that in any way affect the use of navigable water and adjoining properties of the town;
(3) 
Maintain an up-to-date inventory of all marinas, docks, groins and other facilities within the commercial boating zone and within all other navigable water of the town;
(4) 
Have jurisdiction over the operation and maintenance of the town dock and facilities;
(5) 
Submit to the board of selectmen a proposed set of rules and regulations governing the use of the town dock, landings and stakes;
(6) 
Be responsible for recommending safety regulations for all navigable waters of the town; this would include safety measures for swimming and boating activities along the entire town shoreline;
(7) 
Review applications and make recommendations regarding the construction of any groins, jetties or other installations that may affect navigation and/or the property rights of others;
(8) 
Make all rules, regulations, judgments and recommendations with due consideration to their environmental impact on the navigable waters and adjacent properties in the town and in neighboring communities.

The harbor management commission shall annually submit to the board of finance, at such times as the board of finance shall direct, an itemized statement of the estimated revenues and expenses of its operation for the ensuing year. Also, it shall submit a report of its activities for inclusion in each printed annual town report.

Any violation of the regulations of the harbor management commission shall be punished in accordance with section 1-10.
